ORDINANCE NO: 91-84 - <br /> BY: Brown, Chinnock, <br /> Gal lagher, Graham, <br /> McBride, Salmon, Wendlin§ <br /> AN E~IERGENCY ORDINANCE authorizing the Mayor to enter into <br />a supplemental agreement with the Ohio Department of Natural Resources <br />to accept an increase in the Grant in the amount not to exceed $175,000 <br />for the construction of a public breakwall and fishing access for the <br />preventing, correcting, and arresting of lakeshore erosion and to pro- <br />vide passive recreational activities. (Lakewood Park Breakwall Project). <br /> <br /> WHEREAS, the City of Lakewood is the owner of property <br />located on Lake Erie known as Lakewood Park where it is proposed to <br />construct a breakwall to arrest shore erosion along the Lakewood Park <br />shoreline, and <br /> <br /> WHEREAS, the Mayor, pursuant to prior authorization, made <br />application for State Funds and pursuant to House Bill No. 798, the <br />General Assembly has appropriated funds for the Lakewood Park Break- <br />wall Project, and <br /> <br /> WHEREAS, it is in the best interest of public health, safety <br />and welfare for the construction of said project to be undertaken jointly <br />by the State of Ohio and the City of Lakewood which cooperative effort is <br />authorized pursuant to Ohio Revised Code, Section 1501.02, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure <br />in that it provides for the immediate preservation of the public <br />health, safety and welfare; now, therefore, <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, <br />STATE OF OHIO: <br /> <br /> Section 1. That the Mayor be and he is hereby authorized <br />and directed to enter into a supplemental agreement with the Ohio <br />Department of Natural Resources to accept an increase in the grant <br />in .an amount not to exceed $175,000 for the construction of a public <br />breakwall and fishing access for the preventing, correcting and <br />arresting of lakeshore erosion along certain shoreline of Lake Erie <br />and to provide passive recreational activities, designated as the <br />Lakewood Park Breakwall Project. Such agreement shall be substan- <br />tially in the form attached hereto as Exhibit 'A'. <br /> <br /> Section 2. It is found and determined that all formal <br />actions of this Council concerning and relating to the passage of <br />this ordinance were adopted in an open meeting of this Council, and <br />that all such deliberations of this Council and of any of its <br />committees that resulted in such formal action, were in meetings <br />open to the public, in compliance with all legal requirements zn- <br />eluding Section 121.22 of the Ohio Revised Code. <br /> <br />Adopted: <br /> <br /> Section 3. That this ordinance is hereby declared to be <br />an emergency measure for the reasons stated in the preamble hereof <br />and provided it receives the affirmative vote of two-thirds of all <br />members of Council, it shall take effect and be in force immediately <br />upon its adoption and approval by the Mayor; otherwise it shall take <br />effect and be in force after the earliest period allowed by law. <br /> <br />Approved: <br /> <br />~ Ulerk <br /> <br /> <br />
