EXHIBIT 'A' SUPPLEMENTAL A~FCE~ NO. 3 ~REAS, an agreement was entered into on November 15, 1982, between the State of Ohio, Department of Natural Resources and the City of Lakewood, 12650 Detroit Avenue, Lakewood, Ohi° for the construction of a breakwall project to arrest shore erosion along the L~kewood Park shore- line on Lake Erie in the City of Lakewood, and WHEREAS, it has been determined to expand the amount of the Project scope from $1,650,000 to $1,825,000, an increase in the amount of $175,000, to provide additional breakwall protection and to provide fishing access, and WHEREAS, funds in the amount of $175',000 to cover the increase in the Project scope amount have been released by the Controlling Board as of July 30, 1984, and funds have been encumbered by Contract Encumbrance Record Number , and are so certified by the Director of Budget & Management on , 1984. Obligations of the State are subject to the provisions of Section 131.17, of the Ohio Revised Code. NOW THEREFORE, it is mutuall~ agreed between the State of Ohio, acting by and through the Director, Department of Natural Resources and the City of Lakewood, that the Agreement of November 15, 1982, Supplemental Agree- ment No. I and Supplemental Agreement No. 2 are hereby amended as follows: Revise Clause 3 to read as follows: 3) The STATE will p~v to the OIT~, the actual cost of the project construction, not to exceed the amount of $1,825,O00. Project costs shall include engineering, design and supervisions costs, advertising costs, and construction costs. Any work performed by CITY staff on this project shall not be eligible as part of the Project cost.
