Section 913.08: POWERS AND AUTHORITY OF INSPECTORS <br /> <br />a) The City Engineer shall inspect the facilities of any user to <br /> ascertain whether the purpose of this Chapter is being met and <br /> all requirements are being complied with. Persons or occuPants <br /> of premises where wastewater is created or discharged shall allow <br /> the City Engineer ready access at all reasonable times to all parts <br /> of the premises for the purpose of inspection, observation, measure- <br /> ment, sampling, testing, record examination or in the performance of <br /> any of their duties. The City Engineer, Ohio EPA, and USEPA shall <br /> have the right to set up on the user"s property such devices as are <br /> necessary to conduct sampling, inspection, compliance monitoring <br /> and/or metering operations. Where a user has security measures in <br /> force which would, require proper identification and clearance before <br /> entry into their premises, the user shall make necessary arrangements <br /> with any security guards so that upon presentation of suitable identi- <br /> fication, the City Engineer, OEPA, and USEPA will be permitted to enter <br /> without delay, for the purpose of performing their specific responsi- <br /> bilities. <br /> <br />b) The City Engineer shall have no authority to inquire into any <br /> industrial processes beyond that point in the process having <br /> a direct bearing on the kind and source of discharge to the <br /> sewers or waterways or facilities for treatment. <br /> <br />c) While performing the necessary work on private properties referred <br /> to in Subsections (a) and (b) above, the City Engineer of the City <br /> of LakeWood shall observe all safety rules applicable to the premises <br /> established by the company. <br /> <br />d) The City Engineer of the City of Lakewood bearing proper creden- <br /> tials and identification shall be permitted to enter all private <br /> properties through which the City of Lakewood holds a duly nego- <br /> tiated easement for the purpose of, but not limited to, inspec- <br /> tion, observation, measurement, sampling, repair and maintenance <br /> of any portion of the wastewater disposal system lying within <br /> said easement. All entry and subsequent work, if any, on said <br /> easement, shall be done in .full acco~rdance with the terms of the <br /> duly negotiated easement pertaining to the private property in- <br /> volved. <br /> <br />Section 913.09: LIABILITY <br /> <br />a) Each user or owner shall be responsible for maintenance and cleaning <br /> his sewer connection from the house to the street right-of-way bound- <br /> ary. The City shall not be liable for any stoppages in the sewers. <br /> Each user should provide a suitable back water valve to prevent <br /> flooding of basements in the event of sewer stoppage. <br /> <br />b) Any sewer connection that is abandoned for non-use or found not to <br /> meet all requirements of Section 913.05 shall be disconnected and <br /> plugged at the municipal sewer location by means acceptable to the <br /> Director of Public Works. All costs and expenses incidental to <br /> disconnecting the building sewer shall be borne by the owner. <br /> <br /> <br />
