Section 913.08: POWERS AND AUTHORITY OF INSPECTORS a) The City Engineer shall inspect the facilities of any user to ascertain whether the purpose of this Chapter is being met and all requirements are being complied with. Persons or occuPants of premises where wastewater is created or discharged shall allow the City Engineer ready access at all reasonable times to all parts of the premises for the purpose of inspection, observation, measure- ment, sampling, testing, record examination or in the performance of any of their duties. The City Engineer, Ohio EPA, and USEPA shall have the right to set up on the user"s property such devices as are necessary to conduct sampling, inspection, compliance monitoring and/or metering operations. Where a user has security measures in force which would, require proper identification and clearance before entry into their premises, the user shall make necessary arrangements with any security guards so that upon presentation of suitable identi- fication, the City Engineer, OEPA, and USEPA will be permitted to enter without delay, for the purpose of performing their specific responsi- bilities. b) The City Engineer shall have no authority to inquire into any industrial processes beyond that point in the process having a direct bearing on the kind and source of discharge to the sewers or waterways or facilities for treatment. c) While performing the necessary work on private properties referred to in Subsections (a) and (b) above, the City Engineer of the City of LakeWood shall observe all safety rules applicable to the premises established by the company. d) The City Engineer of the City of Lakewood bearing proper creden- tials and identification shall be permitted to enter all private properties through which the City of Lakewood holds a duly nego- tiated easement for the purpose of, but not limited to, inspec- tion, observation, measurement, sampling, repair and maintenance of any portion of the wastewater disposal system lying within said easement. All entry and subsequent work, if any, on said easement, shall be done in .full acco~rdance with the terms of the duly negotiated easement pertaining to the private property in- volved. Section 913.09: LIABILITY a) Each user or owner shall be responsible for maintenance and cleaning his sewer connection from the house to the street right-of-way bound- ary. The City shall not be liable for any stoppages in the sewers. Each user should provide a suitable back water valve to prevent flooding of basements in the event of sewer stoppage. b) Any sewer connection that is abandoned for non-use or found not to meet all requirements of Section 913.05 shall be disconnected and plugged at the municipal sewer location by means acceptable to the Director of Public Works. All costs and expenses incidental to disconnecting the building sewer shall be borne by the owner.
