ORDINANCE NO, 2-85 BY, Brown, Chinnock, Gallagher, Graham, McBride, Salmon, Wendling AN E!lERGENCY ORDINANCE consenting to the improvement of Lake Road, from Clifton Boulevard to Webb Road, in the City of Lakewoo-d,_ all in accordance with plans J specifications and estimates prep-ared by, the City Engineer and under the supervis ion of the Depart- ment of Transportation, S,tate of Ohio. HHEREAS, the Department of Transportation, State of Ohio, is considering the repair and resurfa£ing of Lake Road from Clifton Boule- vard to Webb Road in the City of Lakewood; and; WHEREAS, this Counc.il has. determined that the improvements herein provided are necess~ry to eliminate existing hazards to vehicular traffic using the streets of the City of Lakewood, and; WHEREAS I' this ordinance. constitutes. an emergency measure pro- vidingfor the iI11Ji1ediate preservation öf the public health, safety and welfare J-. said emergency existing by the present condition of said road and for the further reason that it, is necessary to. expedite the prepara- tion of the plans and specifications for the improyement; now, therefore, OF OHIO, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE Section 1. That it is declared to be in the public interest that the consent of the City ófLakewood be and such consent is here- by given to the Department of' Transportation, State of Ohio, to con- struct the above-described improvements in accordance with the plans, specifications and estimates approved by the Department of Transpor- tation, State of Ohio. Section 2. That the City of Lakewood hereby p.roposes to cooperate with thé Department of Transportation, State of Ohio, in the above~described improvement as follows: a) By the p'reparation o'f plans and specifications for the improvement to be approved by the Depart_ ment of Transportat.ionJ State of Ohio; and, b) By assuming and contributing the non-federal share of the project costs. Section 3. That the Hayor of the City of Lakewood is hereby authorized to enter into maintenance and parking agreements and special contractual obligations. Section 4,. That upon completion of said improvements the City of Lakewood will thereafter keep said stre.et open to traffic at all times, and: a) Maintain the imp.rovement in accordance with the provisions of the statutes relating thereto and make ample financial provis.ions for such main- tenance;
