Sec_tion 5. That traffic control s'ignals will not .,be installed on the pToject without prior approval by the Department of Transporta- tion, State 0-£ Ohio, and the City of Lakewood will place and maintain all traffìc control signals conforming to the Ohio Manual of Uniform traffic Gon,trol Devices on the improvement' in compli,ance with the provisions of Section 451l~11 and related sections of the Ohiö Revised Code. Section 6. Right~o£-Way, utility rearrangement· a) That all existing street and public right-of- way within the Municipality which is necessary for the aforeBaid"imp:rovement, shall be made available therefor. b) That any traffi~ sign~lization upgrading, re- location of -p¥blicly owned utilities or water line work made necess-ary__by the improve- ment will be included, in the project but that the City of Lakewood will cause to be made, at no expense to the Department" of Transpor- tation, 3.ta_te" of Ohio, all chan.ges, altera- tions or repair.sto all private or public utilitie,s_ which are not made ne'eess-ary by the improvemen.t. c) That the construction, re~onstruction and/or rearrangemen'ts of' both publicly and privately owned utilities, referred to in subsection (b) aboveF shall be done in such a mapner as not to interfere unduly with the operation of the contractor constructing the improvement, and all backfil1ing o£ trenches made necessary by such utility rearrangement shall be performed ih accordánce with the provision of the Depart- ment of Transportation, State of Ohio Construc- tion and Material Specifications. Section 7.". It is fo,tmd and determined that all formal actions of this Counc1l concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council, and that all such deli- berations of this Council and o'f any of its. corrnnittees that resulted in such formal action, were in meet'ings open to, the public, i~ compliance with all legal requirements including Section 121.22 of the, Ohio Revised Code.
