r'-, " ORDINANCE NO. 3-85 BY: Brown, Chinnock, Ga~lagher, Graham, McBride, Salmon, Wendling AN EMERGENCY ORDINANCE to amend Paragraph (a) of Section 521.06 and Secti on 521.13 of the General Offenses Code of the Codi fi ed Ordi nances of the City of Lakewood relating to snow removal. WHEREAS, complaints have been received and problems have arisen relat- ing to the removal of snow by snow plow operators who deposit th~ snow in large quantities upon the property of others as well as on the public streets and side- walks and/or treelawns not connected to the property from which the snow is be- ing removed, which practices constitute a hazard to the safety and welfare of the citizens of the community, and WHEREAS, this Council determines that it is in the best interest of the community that these practices should be prohibited, and WHEREAS, this ordinance constitutes an emergency measure providing for the immediate preservation of the public safety andweTfare; now, therefore. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOO, STATE OF OHIO: Section 1. That Paragraph (a) of Section 521.06 of the General Offenses Code of the Codified Ordinances of the City of Lakewood, now reading as follows: 521.06 DUTY TO KEEP SIDEWALKS CLEAN. (a) Every owner. occupant or person having charge or any tenement buil di ng, lot or 1 and fronti ng any avenue, street. alley or public highway in the City shall remove and clear away, or caused to be removed or cleared away, snow and ice from a path of at 1 east four feet in wi dth from so much of the sidewalk whether or not fl.agged or paved as is in front of or abuts such bui 1 di ng or 1 at or 1 and. shall be and the same is hereby amended to read as follows: 521.06 DUTY TO KEEP SIDEWALKS CLEAN. No person removing snow from any driveway, sidewalk, public or pri~ate parking lot or privatéþremises within the City shall deposit the same' on the street, pavement, sidéwalk or driveway apron of any public street. Section 2. That Section 521.13 of the, General Offenses i:ode of the Codified Ordinances of the City of Lakewood now reading as follows: 521.13 OPERATION OF PRIVATE SNOWPLOWS. (a) No person engaged in the plowing or removal of snow from dri veways. parki ng lots or other simi 1 ar areas, shall deposit snow therefrom in or upon any public street.
