<br />Section 4. That the General Offenses Code of the Codified <br />Ordinances of the City of Lakewood shall be and the same is <br />hereby supplemented by enacting new Section 533.16 to read as <br />follows: <br /> <br />533.16. POSSESSION OF NUDITY ORIENTED MATERIAL INVOLVING <br />CHILD. <br /> <br />(a) No person shall possess any material that shows a minor <br />who is not the parent's child or ward in a state of nUdity, <br />unless one of thè following applies: <br /> <br />(1) The material is possessed or controlled for a bona <br />fide artistic; medical, scientific, educational, <br />religious, governmental, judicial, or other proper <br />purpose, by or to a physician, psychologist, <br />sociologist, scientist, teacher, person pursuing bona <br />fide studies or research, librarian, clergyman, <br />prosecutor, jUdge, or other persôn having a prQper <br />interest in the material. <br /> <br />(2) The person knows that the parents, guardian, or <br />custodian has consented in writing to photographing or <br />use of the minor in a state of nudity and to the manner <br />in which the material is used or transfered. <br /> <br />(b) Whoever violates this section is guilty of possession <br />or control of nudity oriented material involving a minor, <br />a misdemeanor of the first degree. <br /> <br />Section 5. It is found and determined that all formal <br />actions of this Council concerning and relating to the passag€ of <br />this ordinance were adopted in an open meeting of this Council, <br />and that äll such d€liberations of this Council and of any of its <br />committees that resulted in such formal action, were in mee.tings <br />open to the public, in compliance with all legarrequirements <br />including S€ction 121.122 of the Ohio Revised Code. <br /> <br />Section 6.
