<br />ORDINANCE NO. 39-85 <br /> <br />BY: Brown, Chinnock, Graham <br />Salmõn, WendliQg <br /> <br />AN EMERGENCY ORDINANCE to enact new Chapter 1315 of the <br />Building Code of the Codified Ordinances of the City of Lakewood <br />relating to the establishment of fire limits and repealing <br />existing Chapter 1315. <br /> <br />WHEREAS, on or about March I, 1985, the Ohio State Board <br />of Building Standards deleted all references to fire districts <br />from the Ohio Basic Building Code, which action makes existing <br />Chapter 1315 of the Building Code of the Codified Ordinances of <br />the City of Lakewood null and void, and <br /> <br />WHEREAS, this Council determines it is essential for the <br />City to continue to control the type of construction of buildings <br />and their location to lot lines to prevent the spread of fire <br />within zoning districts BI, BR, MI, M2 and X, and <br /> <br />WHEREAS, this ordinance constitutes an emergency measur,e <br />providing for the immediate preservation of the public health, <br />safety and welfare, now; therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, <br />STATE OF OHIO: <br /> <br />Section 1. That the Building Code of the Codified <br />Ordinancéa of the City of Lakewood shall be and the same is <br />hereby supplemented by enacting new Chapter 1315 to read as <br />follows: <br /> <br />CHAPTER 1315 <br />FIRE LIMIT REG~LA~IOOOS <br /> <br />1315.01 DISTRICTS ESTABLISHED. <br /> <br />(a) Zoning Districts BI, BR, MI, M2, and <br />X or the same as shall be amended from time to - <br />time are hereby declared to be fire limit <br />districts and shall comply with all provisions <br />as set forth below. <br /> <br />(b) All other zoned districts of the <br />City shall be declared outside of the fire <br />limits. <br /> <br />1315.02 <br /> <br />RESTRICTIONS WITHIN FIRE LIMIT <br />DISTRICTS. <br /> <br />(a) All buildings and structures and <br />all addi t ions to ex i st i ng bui ld i ngS and <br />structures hereafter erected within fire <br />limit districts shall be of Type 1, 2A, 2B, <br />3A, and 4, as defined in Article 4 and <br />regulated by Table 401 and any other <br />applicable provisions of the Ohio Basic <br />Building Code except as permitted in <br />1315.02(b) hereof. . <br /> <br />(b) Buildings and structures, and all <br />additions to existing buildings and <br />structures hereafter erected within fire limit <br />districts may be of Type 2C, 3B and 5A <br />construction as defined in Article 4, and <br />regulated in Tables 401, 501, and any other <br />applicable provisions of the Ohio Basic <br />Building Code when constructed and located in <br />accordance with the requirements of the <br />following Table A: <br /> <br />1 <br />
