ORDINANCE NO. 61-85 <br /> <br />Brown, Chinnock, Gallagher, Graham, <br />McBride, Salmon, Wendling <br /> <br /> AN EHERGENC¥ ORDINANCE providin8 for the submission to the <br />electors of the City of a proposed rmendmant to the Amended Charter of <br />the City of Lakevood to mmend Sections 6,, 8, 9 ~nd 11 of Article IX to <br />require that declarations and petitions of c~ndidacy be filed with the <br />election authorities seventy-five (75) days prior to the day of the <br />primary election, and to otherwise require that declarations and <br />petitions of candidacy, the'form of the ballot at the City's primary, <br />special and regular municipal elections and the qualification of <br />electors shall be determined by the election authorities in accordance <br />vith the general lays of Ohio. <br /> <br /> liHEREAS, pursuant to the ABended Charter of the City and the <br />Constitution of the State of Ohio, the Council has datarmined to <br />authorize and direct the submission to the alectors of the City of <br />Lakevood of the proposed Charter amendment hereinafter sat forth, at the <br />general and regular municipal election to be held on November 5, 1985, <br />vhich election is not less than 60 nor more tJmn 120 days from the date <br />of passage of this ordinance; and <br /> <br /> I~HEREAS, this Council by two-thirds vote of the me.bets elected <br />thereto determines that this ordinance is an emergency measure which is <br />necessary for the immediate preservation of the public peace, property, <br />health and safety and for the further reason that this ordinance must be <br />immediately effective in order to permit the election herein called to <br />be held on the date specified in this ordinance; <br /> <br /> NO~, THEREFORE, BE IT ORDAINED by the Council of the City of <br />Lakewood, Cuyahoga County, Ohio: <br /> <br /> Section 1. That this Council hereby authorizes and directs <br />the submission to the electors of the City of Lakevood at the general <br />and regular municipal election to be held at the usual places of voting <br />in the City on Tuesday, November 5, 1985, of the folloving proposal to <br />amend the Amended Charter of the City. <br /> <br /> That Sections 6, 8, 9 ond 11 of Article IX of the Amended <br />Charter of the City of Lake~ood be maended to read as follovs: <br /> <br />SECTION 6. DECLARATIONS OF CANDIDACY. <br /> <br /> Candidates for the offices of Nayor and member <br />of Council shall, not later than four p.m. of the <br />seventy-fifth day before the day of the primary <br />election, file a declaration and petition of <br />candidacy as required by the general lm~s of the <br />State of Ohio, Except as otherwise required by this <br />Charter, the general Laws of Ohio shall govern the <br />following matters: (i) the number of signatures on <br />and the filing of declarations and petitions of <br />candidacy; (ii) the manner of circulation of <br />declarations and petitions of candidacy; (iii) the <br />availability for public inspection of declarations <br />and petitions of candidacy and (iv) the protest <br />against the candidacy of any person. <br /> <br /> SECTION 8.
