AGREEMENT This Agreement is made and entered into this 3rd day of September, 1985 by and between the Ohio Department of Development (hereinafter referred to as the "Department") and the City of Lakewood (hereinafter referred to as the "Grantee"} . RECITALS WHEREAS, the Grantee will establish a full time position of municipal energy manager (MEM); and WHEREAS, the Department is mandated by Section 1551.05(I) to "implement continuing public education effort ... about specific ways to conserve er " en gy , and WHEREAS, the Department has available funds in the amount of sixty-two thousand five hundred dollars ($62,500) to assist in defraying a portion of the expenses associated with the above. NOW, THEREFORE, in consideration of the covenants and agreements herein contained to be performed by the parties hereto, it is mutually agreed by the Department and the Grantee that: ® ARTICLE I. GRANT OF MONEYS The Department shall grant funds to the Grantee in the amount of sixty-two thousand five hundred ($62,500) for the express purpose of assisting the Grantee in defraying a portion of the expenses associated with work described in Exhibit A and as outlined in the following. The Grantee shall use grant funds to provide for all work described in the attached proposal from the grantee (attachment A) and summarized as follows: a. Establish the Municipal Energy Manager. b. Survey city buildings, establish energy saving opportunities, and initiate low-cost measures. Establish an energy savings payback fund consisting of monies saved through energy cost reduction measures. These funds will be used to finance energy conserving capital improvements. These funds will also be used to support the program positions after termination of this contract. ARTICLE II. PAYMENT OF MONEYS Payment to the grantee will be in monthly installations upon receipt and acceptance of the grantee's request for payment for the term of the grant.
