ARTICLE III. CONDITIONS The Grantee shall record all moneys received under paragraph I of this Agreement in a separate account on the books and records of the Grantee. The Grantee shall provide for the expenditure of said moneys for the express purpose outlined in Exhibit A and as described in Paragraph 2. 3. Grantee shall submit the following reports to the Department: ® aJ A monthly Financial and Performance Report for receipt by the Department and by the tenth day following the end of each month until all grant funds are expended or the grant terminates. One (1) copy must be submitted with an original signature. The scope of these reports must include information on the status of work activities and their resulting products as described in Exhibit A. b® A final Financial and Performance Report no later than 30 days after the 9rant terminates. One (1) copy must be submitted with an original signature. The Performance Report must include information that describes the progress made in performing the work activities and their resulting products as described in Exhibit A. Grantee shall also furnish to the Department upon request, copies of studies, reports, surveys, proposals, plans, codes and regulations, maps, charts, schedules, photographs, exhibits, and any other material s prepared or developed under this Agreement. All moneys granted to the Grantee under this Agreement, including interest income from the deposit of said moneys, are to be used solely for the express purpose set forth in Exhibit A. In no event shall said moneys be used for any other purpose than that described in this Agreement. The Grantee shall not pledge said moneys as security for any other loan or debt of any kind other than that described in this Agreement. If said money and interest income is not so used, it shall be returned to the Department. In the event that the total amount of the grant and interest exceeds the cost of the project, the remaining moneys shall be returned to the Department. During the period the Grantee holds the grant money, the Grantee hereby agrees to defend and hold the Department from any liability in case of claim or suit arising from the management of or acts incidental to the project. It is expressly understood by the parties that none of the rights, duties and obligations described in this Agreement shall be binding on either party until such time as all necessary funds are made available and forthcoming from the appropriate state agencies. Term of the Agreement shall be for 18 months from the date it is signed.
