with the terms and conditions of this Agreement within seventy- <br />five (75) days after receip~i of said notice, unless a delay is <br />caused by circumstances beyond the reasonable control of Company, <br />the City after a public hearing affording the Company due process <br />shall have the right to cancel this franchise. <br /> <br />SECTION 25. SEVERABILITY <br /> <br /> All terms and conditions of this Agreement are subject to <br />the rules and regulations of the FCC and all applicable state and <br />federal laws. If any provision of this Agreement is held by any <br />court or federal or state aKency of competent jurisdiction to be <br />invalid as conflictin~ with any federal or state law, rule or <br />regulation now or hereafter in effect, or if held by any such <br />court or a~ency to be modified in any way in order to conform to <br />the requirements of any such law, rule or regulation, said <br />provision shall be considered a separate, distinct and <br />independent part of this A~reement, and such holdin~ shall not <br />affect the Validity and enforceability of any other provisions <br />hereof. Notwithstanding the foregoing, if any part of this <br />A~reement is declared or found to be invalid by the FCC or any <br />court or agency of competent 3urisdiction, such part may, at the <br />option of either party, be rene~otiated. <br /> <br />- 25 - <br /> <br /> <br />
