following provisions <br />floodway areas: <br /> <br />apply within all <br /> <br />delineated <br /> <br />(a) Prohibit encroachments, including fill, <br />new construction, substantial improvements, <br />and other development unless a technical <br />evaluation demonstrates that encorachments <br />shall not result in any increase in flood <br />levels during the occurrence of the base <br />flood discharge. <br /> <br />(b) If subsection (a) hereof is satisfied, <br />all new construction and substantial <br />improvements shall comply with all applicable <br />flood hazard reduction provisions of Section <br />1307.18 and 1307.19. <br /> <br />1307.99 PENALTY. <br /> <br />Whoever violates any provision of this Code or any <br />rule or regulation promulgated hereunder, or fails <br />to comply herewith or with any written notice or <br />order issued hereunder is guilty of a misdemeanor <br />of the first degree. Each day such violation occurs <br />or continues to occur shall constitute a separate <br />offense. <br /> <br /> Section 2. It is found and determined that all formal <br />actions of this Council concerning and relating to the passage of this <br />ordinance were adopted in an open meeting of this Council, and that <br />all such deliberations of this Council and of any of its committees <br />that resulted in such formal action, were in meetings open to the <br />public, in compliance with all legal requirements including Section <br />121.22 of the Ohio Revised Code. <br /> <br /> Section 3.
