herein as a site for the deposit of clean fill material <br /> consisting only of dirt and concrete (the "Site"). <br /> <br /> 3. Ths City agrees to route all trucks to <br /> the Site via the City's concrete dump road located in <br /> Lakewood Park adjacent to Owner's property. <br /> <br /> 4. The Owner agrees that the sole authority <br />as to who shall be permitted to deposit fill material at the <br />Site shall be with the City and agrees further that it shall <br />permitfno person, firm, or corporation to deposit fill <br />material at the Site save and except such persons, firm or <br />corporation specifically authorized by the Director of <br />Public Works of the City. <br /> <br /> 5. The City agrees to properly secure the <br />Site by means of such fences, bushes and/or other barriers <br />as are necessary to adequately protect against trespass and <br />the City also agrees to adequately maintain such protective <br />measures at all times. <br /> <br /> 6. The City agrees to limit filling opera- <br />tions at the Site to the hours between 8:30 a.m. and 6:30 <br />p.m. such that neighboring residents shall not be unduly <br />disturbed by the filling activities. <br /> <br /> 7. The City agrees at all times to control <br />dust at the Site by appropriate wet-down treatment and to <br />keep the Site clean and free of all foreign (non-dirt, <br />non-concrete) materials. <br /> <br /> 8. The City agrees to obtain any and all <br />necessary permits for the Site and filling activities from <br />any and all requisite local, state or federal authorities. <br /> <br /> 9. The City agrees that it shall maintain <br />the slope of the fill at a ratio of approximately 2:1 during <br />the time this Agreement is in full force and effect, and at <br /> <br />-2- <br /> <br /> <br />
