DESIGNATED AGENCY AGREEMENT This Agre.ement is made and entered into on the _ day of , 19 , by and between the Cuyahoga County' Depart- me. nt of Human Services', (hereinafter referred to as "Department" and , (hereinafter referred to as "Agency") doing'business at Ohio. - The Department is authorized by Section 5101..62 of the Ohio Revised Code to designate another Agency to perform the Department's duties as spe- cified in Section 5101.60 through 5101.71 of the Ohio Revised Code. The following are the terms of the Agreement: I. The Department agrees to implement Section 5101.62 of the Ohio Revised Code and Designates to perform certain duties as specified in ORC Section 5101.60 and 5101.71 when: A. The elderlYperson who is reported to the Department as being abused, neglected, or exploited is an active client of the designated Agency identified abovelor B. The elderly person who is reported as being abused, ,neglected or exploited was an active client of the designated Agency identified about within twelve (12) months prior to the ~epeipt of the report. The only exceptions to the above conditions would occur if (1) the Department agrees with the designated Agency that 'the Agency's assessment would not be in the best interest of the client or the Agency; (2) the situation is identified as an emergency (the Department will not assign emergency situ- ations to an Agency until they are stabilized); (3) certain eXclusionary situations exist, (e.g., geographical, cultural and religious); (4) the Department agrees with the Agenc~ that the Agency's involvement would result in a conflict of interest; (5) the Agency in good faith or for valid reasons declines.
