ORDINANCE NO. 43-87 <br /> <br />BY: Brown, Gallagher, Graham, <br /> McBride, Salmon, Wendling <br /> <br /> AN EMERGENCY ORDINANCE providing for the sale of the vacated <br />portion of West Shore Court situated west of 15710 West Shore Court <br />(Permanent Parcel No. 311-13-54) in the City of Lakewood, Ohio. <br /> <br /> WHEREAS, this Council determines that the City is the owner <br />of West Shore Court, a portion of which situated west of 15710 West <br />Shore Court is to be vacated, and <br /> <br />of said <br />adjacent <br />cash, and <br /> <br />WHEREAS, this Council determines that such vacated portion <br />real estate should be sold to the owners of the property <br />to and immediately to the north of said vacated portion for <br /> <br /> WHEREAS, this Council determines that such said is in the <br />best interest of the City and will further the interests of the City <br />and its residents, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure <br />providing for the immediate preservation of the public health, safety <br />and welfare and for the usual daily operation of a municipal <br />department; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE <br /> <br />OF OHIO: <br /> <br /> Section 1. It is hereby determined that the real property <br />described in the Agreement set forth herein should be sold to the <br />owners of abutting property situated immediately to the north of said <br />premises for cash. <br /> <br /> Section 2. It is hereby determined that such sale is in the <br />best interest of the City and will further the interests of the City <br />and its residents. <br /> <br /> Section 3. That this Council hereby authorizes the sale of <br />said land to Wilbur S. Kohring and Judith C. Kohring, husband and <br />wife, and the Mayor is hereby authorized and directed to execute on <br />behalf of the City of Lakewood a contract for the sale of said <br />property in substantially the following form: <br /> <br />AGREEMENT <br /> <br /> THIS AGREEMENT made and concluded at Lakewood, Ohio, this <br /> day of , 1987, by and between the CITY OF <br />LAKEWOOD, whose mailing address is 12650 Detroit Avenue, Lakewood, <br />Ohio, (hereinafter referred to as "Vendor") and WILBUR S. KOHRING and <br />JUDITH C. KOHRING, husband and wife, whose mailing address is 1054 <br />Summit Avenue, Lakewood, Ohio, (hereinafter referred to as "Vendees"). <br /> <br />W I T N E S S E T H: <br /> <br /> That in consideration of the mutual promises of the parties <br />herein contained, the Vendor agrees to sell and convey and the Vendees <br />agree to purchase and pay for, upon and under the provisions, terms <br />and conditions herein expressed, the following described premises: <br /> <br />SITUATED in the City of Lakewood, County of <br />Cuyahoga and State of Ohio and known as being a <br />part of Sublot No. 12 in the .3. J. Donovan Realty <br />Co's Subdivision of Block "A" of The Hiram Barrett <br />Re-Subdivision of a part of Original Rockport <br />Township Section No. 22, as Recorded in Volume 35 <br />Page 15 of Cuyahoga County Map Records and bounded <br />and described as follows: <br /> <br /> <br />
