ORDINANCE NO. 43-87 BY: Brown, Gallagher, Graham, McBride, Salmon, Wendling AN EMERGENCY ORDINANCE providing for the sale of the vacated portion of West Shore Court situated west of 15710 West Shore Court (Permanent Parcel No. 311-13-54) in the City of Lakewood, Ohio. WHEREAS, this Council determines that the City is the owner of West Shore Court, a portion of which situated west of 15710 West Shore Court is to be vacated, and of said adjacent cash, and WHEREAS, this Council determines that such vacated portion real estate should be sold to the owners of the property to and immediately to the north of said vacated portion for WHEREAS, this Council determines that such said is in the best interest of the City and will further the interests of the City and its residents, and WHEREAS, this ordinance constitutes an emergency measure providing for the immediate preservation of the public health, safety and welfare and for the usual daily operation of a municipal department; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. It is hereby determined that the real property described in the Agreement set forth herein should be sold to the owners of abutting property situated immediately to the north of said premises for cash. Section 2. It is hereby determined that such sale is in the best interest of the City and will further the interests of the City and its residents. Section 3. That this Council hereby authorizes the sale of said land to Wilbur S. Kohring and Judith C. Kohring, husband and wife, and the Mayor is hereby authorized and directed to execute on behalf of the City of Lakewood a contract for the sale of said property in substantially the following form: AGREEMENT THIS AGREEMENT made and concluded at Lakewood, Ohio, this day of , 1987, by and between the CITY OF LAKEWOOD, whose mailing address is 12650 Detroit Avenue, Lakewood, Ohio, (hereinafter referred to as "Vendor") and WILBUR S. KOHRING and JUDITH C. KOHRING, husband and wife, whose mailing address is 1054 Summit Avenue, Lakewood, Ohio, (hereinafter referred to as "Vendees"). W I T N E S S E T H: That in consideration of the mutual promises of the parties herein contained, the Vendor agrees to sell and convey and the Vendees agree to purchase and pay for, upon and under the provisions, terms and conditions herein expressed, the following described premises: SITUATED in the City of Lakewood, County of Cuyahoga and State of Ohio and known as being a part of Sublot No. 12 in the .3. J. Donovan Realty Co's Subdivision of Block "A" of The Hiram Barrett Re-Subdivision of a part of Original Rockport Township Section No. 22, as Recorded in Volume 35 Page 15 of Cuyahoga County Map Records and bounded and described as follows:
