ORDINANCE NO. 54-87 BY: Brown, Chinnock, Gallagher, Graham, McBride, Salmon, Wendling AN EMERGENCY ORDINANCE enacting new Section 129.32 of the Administrative Code of the Codified Ordinances of the City of Lakewood to establish a Law Enforcement Trust Fund and a Drug Law Enforcement Fund. WHEREAS, this Council determines that there is a compelling governmental interest to establish a Law Enforcement Trust Fund and a Drug Law Enforcement Trust Fund to provide for the deposit of forfeitures and fines, and WHEREAS, Ohio Revised Code Sections 2923.35 and 2933.43(D) (4) authorize payments to municipalities from contraband or other property ordered forfeited fines or civil penalties if ordered by the Court, under Ohio Revised Code Sections 2923,32, 2923,01, 2933.42 or 2933.43, and WHEREAS, Ohio Revised Code Section 2925.03{J) and (K} authorize payments to municipalities from fines and bond forfeitures to be used solely for drug enforcement purposes, and WHEREAS, in order to receive such payments, the municipality must establish a Law Enforcement Trust Fund and a Drug Law Enforcement Fund, and WHEREAS, payments from both of said Funds can only be made for certain designated purposes, and WHEREAS, this Council deems it advisable to establish the Law Enforcement Trust Fund and a Drug Law Enforcement Fund to receive said payments, the monies from which may be used for the law enforcement purposes as outlined in Ohio Revised Code, and WHEREAS, this ordinance constitutes an emergency measure providing for the usual daily operation of a municipal department; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the Administrative Code of the Codified Ordinances of the City of Lakewood is hereby supplemented by enacting new Section 129.32 thereof to read as follows: 129.32 LAW ENFORCEMENT TRUST FUND AND DRUG LAW ENFORCEMENT FUND (a) There is hereby established a Law Enforcement Trust Fund to be operated in accordance with the requirements of Ohio Revised Code Sections 2923.35 and 2933.43{D) (4) providing that the funds received thereunder shall only be expended to pay the cost of protracted or complex investigations or prosecutions, to provide reasonabl- technical training or expertise, to provide matching funds to obtain federal grants to aid law enforcement, and/or for such other law enforcement purposes as the Chief of Police and the Director of Public Safety deem to be appropriate. (b) There is hereby established a Drug Law Enforcement Fund in accordance with the requirements of Ohio Revised Code Section 2925.03{J) and 2925.03(K) providing that the funds received thereunder shall be expended only towards law enforcement efforts that pertain to drug offenses.
