Placed on Second Reading on July 1', ORDINANCE NO. 58-87 BY: Brown, Chinnock, Gallagher, Graham, Salmon, Wendling AN EMERGENCY ORDINANCE to amend paragraph (c) and enact new paragraph (e) of Section 351.99 of the Traffic Code of the Codified Ordinances of the City of Lakewood to increase the fine for violations of handicapped parking regulations. WHEREAS, this Council determines that the violation of handicapped parking regulations is of such nature that the fine for same should be increased from its present 85.00 minimum $10.00 maximum waiver limits to further discourage the prevalent violation of such regulations by so many motorist, and WHEREAS, this ordinance constitutes an emergency measure providing for the immediate preservation of the public safety and welfare and for the usual daily operation of a municipal department; now, therefore, OF OHIO: BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE Section 1. That paragraph (c) of Section 315.99 of the Traffic Code of the Codified Ordinances of the City of Lakewood, now reading as follows: 351.99 PENALTY AND WAIVER (a) (b) (c) Whoever violates Sections 351.01(a) through (p), (r) or (s) through 351.18, Section 351.20(d) or (c) or Section 351.23 may, in lieu of the other penalties provided for the violation of such provisions and upon signing a waiver, be fined five dollars ($5.00) if such violator pays such fine at the Traffic Bureau, in person or by mail, within forty- eight hours, or if not within forty-eight hours, then in the sum of ten dollars ($10.00) if such violator pays such amount at the Traffic Bureau, in person or by mail, within seventy-two hours from the time of violation. In the event such violator does not pay the fine as hereinbefore provided, then a warrant shall be issued and such violator shall be subject to the penalties otherwise provided for the violation of such provisions. shall be and the same is hereby amended to read as follows: 351.99 PENALTY AND WAIVER.
