In the event such <br />violator does not pay the fine as <br />hereinbefore provided, then a warrant shall <br />be issued and such violator shall be subject <br />to the penalties otherwise provided for the <br />violation of such provisions. <br /> <br /> Section 2. That Section 351.99 of the Traffic Code of the <br />Codified Ordinances of the City of Lakewood be and the same is hereby <br />supplemented by enacting new paragraph (e) thereof to read as follows: <br /> <br />351.99 PENALTY AND WAIVER. <br /> <br />(a) <br />(b) <br />(c) <br />(d) <br />(e) <br /> <br />Whoever violates Section 351.23 may, in lieu <br />of the other penalties provided for the <br />violation of such section and upon signing a <br />waiver be fined twenty-five ($25.00) dollars <br />if such violator pays such fine at the <br />Traffic Bureau, in person or by mail, within <br />forty-eight hours, or if not within forty- <br />eight hours, t~hen in the sum of forty <br />($40.00) dollars if such violator pays such <br />amount at the Traffic Bureau, in person, or <br />by mail, within seventy-two hours from the <br />time of the violation. In the event such <br />violator does not pay the fine as <br />hereinbefore provided, then a warrant shall <br />be issued and such violator shall be subject <br />to the penalties otherwise provided for the <br />violation of such provision. <br /> <br /> Section 3. It is found and determined that all formal <br />actions of this Council concerning and relating to the passage of this <br />ordinance were adopted in an open meeting of this Council, and that <br />all such deliberations of this Council and of any of its committees <br />that resulted in such formal action were in meetings open to the <br />public in compliance with all legal requirements. <br /> <br /> Section 4. That this ordinance is hereby declared to be an <br />emergency measure for the reasons stated in the preamble hereof and <br />provided it receives the affirmative vote of two-thirds of all members <br />elected to Council, it shall take effect and be in force from and after <br />0ctober 5, 1987, and approval by the Mayor; otherwise, it shall take <br />effect and be in force after the earliest period allowed by law and <br />existing paragraph (c) of Section 351.99 shall be and the same is <br />hereby repealed at such time. <br /> <br />Adopted: ~ ~/ /q:~ <br /> <br /> <br />
