~Ptaced On First Reading on <br /> PLACED ON SECOND ~EADING 11/6/89 <br /> <br />ORDINANCE NO. 14-88 BY: Brown, Chinnock, Gallagher~ Gazzana, <br /> George, Graham, Wendling <br /> <br /> AN EMERGENCY ORDINANCE to amend paragraph (b) of Section 1783.05 and <br />1783.07 of the Sanitary Code of the Codified Ordinances of the City of Lakewood <br />relating to the number of required receptacles to be used for garbage. <br /> <br /> WHEREAS, this Council feels it is necessary to protect the rights of the <br />citizens from the accumulation of garbage, rubbish, litter and debris, and <br /> <br /> WHEREAS, Council has created the Clean Community System for the enforcement <br />of Litter Less Lakewood, and <br /> <br /> WHEREAS, the City of Lakewood has many multi-family units that receive City <br />refuse pickup, and <br /> <br /> WHEREAS, in order to insure that the areas which are used to store garbage <br />for these multi-family units are free from the accumulation of piled garbage and <br />litter it has become necessary to require more receptacles for the storage of <br />garbage than is currently mandated by existing Section 1783.05, paragraph (b), <br />and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure providing for the <br />immediate preservation of the public health, safety, and welfare, and for the <br />usual daily operation of a municipal department; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAK'EWOOD, STATE OF OHIO: <br /> <br /> Section 1. That paragraph (b) of Section 1783.05 of Sanitary Code of the <br />Codified Ordinances of the City of Lakewood, now reading as follows: <br /> <br />1783.05 Receptacles for Garbage/Refuse/Litter <br /> <br />(a) ... <br /> <br />(b) <br /> <br />For each tenement house, there shall be at least one such receptacle <br />for each floor, and at least one such receptacle for every three <br />families occupying such tenement house. <br /> <br />(c)... <br /> <br />shall be, and the same is hereby amended to read as follows: <br /> <br />1783.05 Receptacles for Garbage/Refuse/Litter <br /> <br />(a)... <br /> <br />(b) For each tenement apartment house using City Refuse disposal there <br /> shall be at least two such receptacles for each apartment Unit. <br /> <br />(c)... <br /> <br /> Section 2. 1783.07 of the Sanitary Code of the Codified Ordinance of the <br />City of Lakewood--Receptacles for Rubbish now reads as follows: <br /> <br />The owner, agent, lessee or occupant of any building or premises where <br />rubbish is produced or permitted to accumulate, shall provide one or more <br />suitable receptacles therefor. For each tenement house, there shall be at <br />least one such receptacle for each floor, and at least one for every three <br />families occupying such tenement house. No rubbish shall be placed or <br />permitted to remain in such building or upon such premises elsewhere than <br />in such receptacles, nor shall any rubbish, dirt or waste, be swept or <br />placed upon any street or sidewalk.
