ORDINANCE NO. 20-88 BY: Brown~ Chinnock, Galla§her, Gazzana, George, Graham~ Wendl'in§ AN EMERGENCY ORDINANCE authorizing the Mayor for and on behalf of the City of Lakewood to renew an agreement with the Cuyahoga County Department of Human Services appointing the City of Lakewood, Department on Aging, as a designated agency to provide investigative services under the Adult Protective Services Law. WHEREAS, Section 5101.62 of the Ohio Revised Code provides that the Department of Human Services may designate another agency to perform the Department's duties under said Section, and WHEREAS, as a designated agency, the City would be able to retain control over its investigation of its own persons and would provide a continuity of care in services already being provided by the City through the Department on Aging, and WHEREAS, the Cuyahoga County Department of Human Services desires to appoint the City of Lakewood, Department on Aging, as a designated agency and this Council determines that it is in the best interest of the City for it to be so designated, specifically for the elderly Lakewood citizens reported to be abused, neglected and/or exploited, and WHEREAS, this ordinance constitutes an emergency measure providing for the immediate preservation of the public health, safety and welfare and for the usual daily operation of a municipal department; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the Mayor be and he is hereby authorized and directed to enter into an agreement with the Cuyahoga County Department of Human Services, 3955 Euclid Avenue, Cleveland, Ohio, 44115, relating to the investigation of reports of elderly Lakewood citizens said to be abused, neglected and/or exploited, said agreement to be substantially in the form of Exhibit "A" attached hereto and made a part hereof as if fully rewritten herein. Section 2. It is found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council, and that all such deliberations of this Council and of any of its committees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements. Section 3. That this ordinance is hereby declared to be an emergency measure for the reasons stated in the preamble hereof and provided it receives the affirmative vote 'of two-thirds of all members elected to Council, it shall take effect and be in force immediately upon its adoption and approval by the Mayor; otherwise, it shall take effect and be in force after the earliest period allowed by law.
