ORDINANCE NO. 20-88 <br /> <br /> BY: Brown~ Chinnock, Galla§her, <br />Gazzana, George, Graham~ Wendl'in§ <br /> <br /> AN EMERGENCY ORDINANCE authorizing the Mayor for and on <br />behalf of the City of Lakewood to renew an agreement with the <br />Cuyahoga County Department of Human Services appointing the City <br />of Lakewood, Department on Aging, as a designated agency to provide <br />investigative services under the Adult Protective Services Law. <br /> <br /> WHEREAS, Section 5101.62 of the Ohio Revised Code provides <br />that the Department of Human Services may designate another agency <br />to perform the Department's duties under said Section, and <br /> <br /> WHEREAS, as a designated agency, the City would be able <br />to retain control over its investigation of its own persons and <br />would provide a continuity of care in services already being <br />provided by the City through the Department on Aging, and <br /> <br /> WHEREAS, the Cuyahoga County Department of Human Services <br />desires to appoint the City of Lakewood, Department on Aging, as a <br />designated agency and this Council determines that it is in the <br />best interest of the City for it to be so designated, specifically <br />for the elderly Lakewood citizens reported to be abused, neglected <br />and/or exploited, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure <br />providing for the immediate preservation of the public health, <br />safety and welfare and for the usual daily operation of a municipal <br />department; now, therefore, <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, <br />STATE OF OHIO: <br /> <br /> Section 1. That the Mayor be and he is hereby authorized <br />and directed to enter into an agreement with the Cuyahoga County <br />Department of Human Services, 3955 Euclid Avenue, Cleveland, Ohio, <br />44115, relating to the investigation of reports of elderly Lakewood <br />citizens said to be abused, neglected and/or exploited, said <br />agreement to be substantially in the form of Exhibit "A" attached <br />hereto and made a part hereof as if fully rewritten herein. <br /> <br /> Section 2. It is found and determined that all formal <br />actions of this Council concerning and relating to the passage of <br />this ordinance were adopted in an open meeting of this Council, <br />and that all such deliberations of this Council and of any of its <br />committees that resulted in such formal action were in meetings <br />open to the public in compliance with all legal requirements. <br /> <br /> Section 3. That this ordinance is hereby declared to be <br />an emergency measure for the reasons stated in the preamble hereof <br />and provided it receives the affirmative vote 'of two-thirds of all <br />members elected to Council, it shall take effect and be in force <br />immediately upon its adoption and approval by the Mayor; otherwise, <br />it shall take effect and be in force after the earliest period <br />allowed by law. <br /> <br />Adopted: <br /> <br />PRES IDENT <br /> <br />Approved: <br /> <br />CLERK <br /> <br />' / ~ ~I/,"'g-MAYOR <br /> <br /> <br />
