DESIGNATED AG_~.~'Cy AGREE:.:~:T <br /> <br /> i'ki~- Agreement is made and entered into on the day of , 19 , <br /> <br />bi' and between the Cuyahoga County Department of Human Services, (hereinafter referred to <br /> <br />as "-~spartment") and _.L. ak_ew_o__o~_.D.e_pa.r .t~e.n_.t.Ork_A.ging .(hereinafter referred to as "Agepcy" <br /> <br /> ihe Department is authorized by Section 5101.62 of the Ohio Revised Code to designate <br /> <br />ano .... r Agency to perform the Department's duties as specified in Section 5101.71 of the <br /> <br />Ohio .Revised Code. The following are the terms of the Agreement: <br /> <br /> [1) The Department agrees to implement Section 5101.62 of the Ohio .Revised Code <br /> <br /> and designates ___L_a_kew. o~_j~o~ .Aging to perform certain <br /> duties as specified in ORC Section 5101.60 and 5101.71, when: <br /> <br /> A__~. The elderly person who is reported to the Department as being abused, <br /> neglected, or exploited is an active client of the designated Agency <br /> identified above or, <br /> <br /> B. The elderly person who is reported as being abused, neglected or ex- <br /> ploited was an active client of the designated Agency identified above <br /> within twelve (12) months prior to the receipt of the report. <br /> <br /> 1. "Active" is defined for purposes of this Agreement <br /> as a client situation of which report has been received <br /> in the Agency's offices· <br /> The only exceptions to the above conditions would occure if (1) the Department agrees <br />with the designated Agency that the Agency's assessment would not be in the best interest <br />of the client or the Agency; (2) the situation is ~dentified as an emergency (CCI)HS will <br />assume responsibility for case servicing of the emergency until the situation has stabilized, <br />at which time case responsibility reverts to the Agency); (3) certain exclusionary sit- <br />uations exist, (e.g., geocjraphical, oultural and religious); (4) the Departraent agrees <br />with the Agency that the Agency's involvement would result in a conflict of interest; (5) <br />the Agency in good faith or for valid reasons declines. <br /> <br /> C._~. It is understood that the Agency has responsibility onl'y for cases <br /> within the city limits of La~-wOg~ . <br /> D. It is understood that the Agency's capacity as a Designated Agency <br /> pursuant to this Agreement shall take precedence over any conflict in its <br /> capacity as a municipal department. <br /> <br /> <br />
