GRDINANCE NO. <br /> <br />and REFERRED to the PLANNING COMMISSION and the <br />PLANNING & ZONING CMTE on 5/15/89~:C.~' <br />PLACED ON SECOND READING on 11/6/89.as amended. <br /> <br />33-89 <br /> <br /> BY: Brown, Chinnock, <br />Gallagher, Gazzana, George, Graham, <br /> Wendling <br /> <br /> AN ORDINANCE to amend the Zoning Code of <br />Ordinances of the City of Lakewood by enacting new <br />entitled "Conditional Uses." <br /> <br />the Codified <br />Chapter 1120 <br /> <br /> WHEREAS, it is well determined that land use control is <br />within the authority of municipal government and it is in the interest <br />of all citizens that the Zoning Code be amended from time to time to <br />reflect changes in our City as well as changes in the comprehensive <br />plan for land use in our City, and <br /> <br /> WHEREAS, a comprehensive land use plan should provide that <br />certain uses in order to be permitted in business or commercial <br />districts require the granting of a conditional use permit because of <br />the potential detriment to neighborhood or potential operation as a <br />nuisance, and <br /> <br /> WHEREAS, the conditional use zoning process requires review <br />from time to time to meet changing conditions in the city and fulfill <br />the purposes, goals and objectives set forth in a comprehensive land <br />use plan, and <br /> <br /> WHEREAS, in recent years, the characteristics and impacts of <br />an ever increasing number of new and unique uses, together with the <br />broadening of numerous conventional uses, have fostered the <br />development of more flexible regulations designed to accommodate these <br />activities in a reasonable and equitable manner while safeguarding <br />both the property rights of all individuals and the health, safety and <br />general welfare of the community, and because of the potential <br />detriment to the neighborhood and possible impact on our community so <br />as to cause deterioration, downgrading or diminuation of property <br />values of certain business uses require additional provisions <br />concerning regulation, and - <br /> <br /> WHEREAS, towards these ends, it is recognized t~at this <br />ordinance should provide for more detailed evaluation of each use <br />conditionally permissible in a specific district with respect to such <br />considerations as location, design, size, method of operation, <br />intensity of use, public facility requirements, and traffic <br />generation. Accordingly, conditional use permits shall conform to the <br />procedures and requirements of this ordinance; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the Zoning Code of the Codified Ordinances <br />of the City of Lakewood be amended by the enactment of new Chapter <br />1120 to read as follows: <br /> <br />CHAPTER 1120 <br /> <br />PROCEDURES AND REQUIREMENTS FOR CONDITIONAL USE <br />PERMITS. <br /> <br />1120.01 REGULATION OF CONDITIONAL USES. <br /> <br />The provisions of this Chapter apply to the <br />location and maintenance of any and all conditional <br /> <br />uses. <br /> <br />1120.02 PURPOSE. <br /> <br />In recent years, the characteristics and impacts of <br />an ever increasing number of new and unique uses, <br />together with the broadening of numerous <br />conventional uses, have fostered the development of <br /> <br />1 <br /> <br /> <br />
