(6) Specified sexual activities and specified <br />anatomical areas: <br /> <br />a. For the .purpose of this section, <br />"specified sexual activities" is defined as: <br /> <br />(i) Human genitals in a state of <br />sexual stimulation or arousal; <br />(ii) Acts of human masturbation, sexual <br />intercourse or sodomy; bondage, <br />sadomasochism, or bestiality; <br />(iii) Fondling or other erotic touching <br />of human genitals, pubic region, buttock <br />or female breast. <br /> <br />b. And "specified anatomical areas" is <br />defined as: <br /> (i) Less than completely and opaquely <br /> covered: <br /> a. Human genitals, pubic region, <br /> b. Buttock, and <br /> c. breast below a point <br /> immediately above the top of the <br /> areola; and <br /> (ii) Human male genitals in a <br /> discernibly turgid state, even if <br /> completely and opaquely covered. <br /> <br />(c) Location Regulations: <br /> <br />Except as otherwise provided under the provisions <br />of this chapter, no building or land shall <br />hereafter be used for any of the uses set out in <br />Section 1120.31 if: <br /> <br />(1) The boundaries of the site of the proposed <br />location is within one hundred fifty (150) feet of <br />a district zoned R1, R2, M1 or M2. <br /> <br />(2) The boundaries of the site of the proposed <br />location is within one thousand (1000) feet of a <br />church or elementary, intermediate or high school, <br />or college, junior college or university. <br /> <br />(3) There is already in existence, one or more <br />regulated uses within one thousand (1000) feet of <br />the boundaries of the site of the proposed <br />regulated use. <br /> <br />(d) Special Provisions: <br /> <br />(1) The use regulated by this Section may be <br />permitted by conditional use permit in a BR, BI or <br />X zoning district in the City of Lakewood as <br />provided by the Board of Zoning Code Appeals after <br />public notice and public hearing when the standards <br />and conditions specified for such use and contained <br />in this section or elsewhere in the codified <br />ordinances of the City of Lakewood are met. <br /> <br />a. Notice by ordinary mail of the public <br />hearing provision shall be given to the owner <br />or owners of all property located within 1000 <br />feet of the property where the special <br />exception is requested. <br /> <br />b. In the granting of such special exception <br />the Board of Zoning Code Appeals may <br />prescribe such additional conditions and <br /> <br /> <br />
