property values of the surrounding neighborhood. <br />The primary purpose of these regulations is to <br />prevent a concentration of these uses in any one <br />area. Uses subject to these controls are: <br /> <br />(1) <br />(2) <br />(3) <br />(4) <br />(5) <br /> <br />Adult book store; <br />Adult motion picture theater; <br />Adult peep show; <br />Massage establishment. <br />Striptease establishment or showbar. <br /> <br />(b) Definitions: <br /> <br />(1) "Adult Book Store" means an establishment <br />having as a substantial or significant portion of <br />its stock in trade, books, magazines and other <br />periodicals or motion picture films, video tapes or <br />sound recordings which are distinguished or <br />characterized by their emphasis on matter <br />depicting, describing or relating to "specified <br />sexual activities or specified anatomicaI areas," <br />(as defined below) or an establishment with a <br />segment or section devoted to the sale or display <br />of such material. <br /> <br />(2) "Adult motion picture theater" means an <br />establishment wherein motion pictures are shown <br />which present material distinguished or <br />characterized by their emphasis on matter <br />depicting, describing or relating to "specified <br />sexual activities" or "specified anatomical areas," <br />(as defined below) for observation by Patrons <br />therein. <br /> <br /> (3) "Adult peep show" means an enclosed building <br />used for presenting material distinguished or <br />characterized by an emphasis on matter depicting, <br />describing or relating to "specified sexual <br />activities" or specified anatomical areas," (as <br />defined below), for observation by patrons therein <br />by means of coin operated or manual operated <br />viewing devices. <br /> <br />(4) "Massage establishment" means any <br />establishment having a fixed place of business <br />where massages are administered for pay, including <br />but not limited to massage parlors, sauna baths and <br />steam baths. This definition shall not be <br />construed to include a hospital, nursing home, <br />medical clinic or the office of a physician, <br />surgeon, chiropractor, osteopath, physical <br />therapist, mechanotherapists, or any other <br />individual or entity duly licensed under the <br />provisions of Section 4731.15 or the Ohio Revised <br />Code. This definition shall also exclude health <br />clubs and other businesses which have facilities <br />for physical exercise, such as tennis courts, <br />racketball courts or exercise rooms, and which do <br />not receive their primary source of revenue <br />through the administration of massages. <br /> <br />(5) "Striptease establishment" or "showbar" means <br />an establishment that features entertainment that <br />includes striptease, nude or semi-nude dancing, or <br />performers in the nude or semi-nude state which <br />such entertainment is not part of a larger <br />theatrical production. <br /> <br /> <br />
