1129.06 PROCEDURES FOR RESUBDIVISIONS AND LOT CONSOLIDATIONS <br /> <br />Resubdivisions and Lot Consolidations shall be governed by the same <br />procedures as Minor Subdivisions, Chapter 1129.03 except, at the <br />discretion of the Planning Director, the preliminary plan may be <br />waived. <br /> <br />1129.07 PROCEDURES FOR LOT SPLITS <br /> <br />Lot Splits do not require plat recording, therefore a formal plat is <br />unnecessary. A Lot Split Map prepared by a professional surveyor <br />registered in Ohio showing existing structures on the parcel(s) in- <br />volved and the proposed lot line change shall be submitted to the <br />Planning Director not less than ten days prior to the next regularly <br />scheduled meeting of the Planning Commission. The Planning Commission <br />shall review the proposed lot split for compliance with Zoning and <br />other City codes. Approval of the lot split shall be noted on the Lot <br />Split Map by signature of the Chairman and the Secretary of the Plan- <br />ning Commission. <br /> <br />1129.08 SEPARABILITY CLAUSE <br /> <br />Each section and each part of each section of this ordinance is hereby <br />declared to be an independent section or part of a section and, not- <br />withstanding any other evidence of legislative intent, it is hereby <br />declared to be the controlling legislative intent that if any such <br />section or part of a section, or any provision thereof, or the appli- <br />cation thereof to any person or circumstances, is held to be invalid, <br />the remaining sections or parts of sections and the application of <br />such provision to any other person or circumstances, other than those <br />as to which it is held invalid, shall not be affected thereby, and it <br />is hereby declared to be the legislative intent that the other provi- <br />sions of this ordinance would have been adopted independently of such <br />section, sections or parts of a section so held to be invalid. <br /> <br />1129.09 PENALTY <br /> <br />(a) Any natural person, including without limitation the president, <br /> chief executive officer, responsible officer or other employee of <br /> a firm or organization, who is convicted of a violation of any <br /> provision of this Chapter shall be guilty of a misdemeanor of the <br /> first'degree and shall be fined not more than one thousand dollars <br /> ($1,000) or shall be imprisoned not more than six months, or both. <br /> <br />(b) Regardless of other penalties provided in this Chapter for the <br /> violation of any provision of this Chapter, any firm, partnership, <br /> corporation, contractor, subcontractor, or other organization that <br /> is convicted of a violation of any provision of this Chapter shall <br /> be guilty of a misdemeanor of the first degree and shall be fined <br /> not more than five thousand dollars ($5,000). <br /> <br />(c) For the purposes of this section, each separate calendar day that <br /> any violation of any provision of this Chapter continues shall <br /> constitute a separate offense. <br /> <br />6 <br /> <br /> <br />
