(c) Approval. Improvement plans, a grading plan and the plat shall be <br /> submitted to the Planning Director and City Engineer and shall be <br /> in conformance with the approved preliminary plan. If the City <br /> Engineer approves the improvement plans and plat and all require- <br /> ments of this Chapter and all other pertinent ordinances of the <br /> City have been complied with, the plans and plat shall be present- <br /> ed to the Planning Commission for approval. Upon approval by the <br /> Planning Commission and certification to that by the signature of <br /> the Chairman and Secretary on the original plat, the plat and <br /> plans will be forwarded to City Council. Council shall act upon <br /> the plans and/or plat either separately or concurrently, but in no <br /> event shall it approve the plat for recording until the improve- <br /> ments are constructed or their construction guaranteed. <br /> <br />When the improvement plans are approved, construction of the <br />improvements may be started. Upon completion of construction of <br />all improvements in accordance with the approved plans, the plat <br />may be approved and recorded, building permits may be issued and <br />lots may be sold, leased or transferred. <br /> <br />(d) <br /> <br />Street Acceptance. Where streets are to be dedicated to public <br />use, upon approval of all improvements by the City Engineer, the <br />developer shall file an abstract, certificate of title, guarantee <br />of title or title insurance in the amount of at least $1,000 with <br />the Law Director showing the title to the street(s) in the subdi- <br />vision to be good in the City for street purposes and to be free <br />and clear of all encumbrances whatsoever. The plat shall then be <br />presented to Council for acceptance and confirmation of the dedi- <br />cation of such street(s). <br /> <br />(e) Recording. The approved plat shall be filed and recorded in the <br /> offices of the County Auditor and County Recorder by an authorized <br /> representative of the City within thirty days after final review. <br /> <br />(f) Fees. A review and recording fee of $300.00 shall be deposited <br /> with the City. No application will be processed until this fee is <br /> received by the City. <br /> <br />1129.05 PERFORMANCE AND MAINTENANCE BONDS <br /> <br />(a) If some improvements are not completed, the City Engineer, in his <br /> sole discretion, may require a performance bond equal to the total <br /> cost of the improvements to be completed. Such bond shall set <br /> forth the City as the beneficiary and shall be issued by a reputa- <br /> ble and solvent bonding company, licensed to do business in Ohio <br /> and shall be deposited with the City Engineer and retained by the <br /> City until all improvements are constructed to the satisfaction of <br /> the City Engineer. <br /> <br />(b) <br /> <br />After the improvements are completed, and accepted by the City <br />Engineer, the developer shall provide the City with a two-year <br />maintenance bond of at least ten percent of the approved estimated <br />cost of construction. Acceptance of the street dedication shall <br />not affect the maintenance bond. The developer shall complete the <br />construction or repairs of all improvements within two years from <br />the date of permission to proceed. Otherwise, the City shall have <br />the right to use the performance bond money to complete the im- <br />provements. The aforesaid two year period may be extended by <br />Council for good cause. <br /> <br /> <br />
