If any proposed lot or parcel does not fully conform with the <br />provisions of the Zoning Code, the Planning Commission shall <br />refer the application to the Board of Zoning Appeals with the <br />request that the Board determine whether the applicant should <br />be entitled to a variance from strict compliance with the <br />provisions of the Zoning Code which the proposed subdivision <br />violates. Upon review and the decision of the Board of Zoning <br />Appeals, the proposed subdivision shall be returned to the <br />Planning Commission for its final review and approval, disap- <br />proval or modification. <br /> <br />After approval by the Planning Commission, the subdivision <br />shall be submitted to City Council for approval at their next <br />regular meeting. If Council concurs with the Planning <br />Commission and approves the subdivision, such approval shall <br />be noted on the plat by the Clerk of Council. <br /> <br />(d) Recording. The approved plat shall be filed and recorded in <br /> the offices of the County Auditor and County Recorder by an <br /> authorized representative of the City within thirty days after <br /> final approval. <br /> <br />(e) Fees. A review and recording fee of one hundred dollars shall <br /> be posted with the City. No application will be processed <br /> until this fee is received by the City. <br /> <br />1129.04 PROCEDURES FOR MAJOR SUBDIVISIONS <br /> <br />(a) Application. A preliminary plan and location map complying with <br /> the requirements set forth in Section 1129.02 shall be prepared <br /> for each proposed major subdivision and submitted with an applica- <br /> tion for approval to the Planning Director not less than ten days <br /> prior to the next regularly scheduled meeting of the Planning <br /> Commission. The purposes of the preliminary plan are to determine <br /> the best design for the subdivision, its relationship to adjoining <br /> subdivisions or other uses and its compliance with the provisions <br /> of these Subdivision Regulations and the Zoning Code. <br /> <br />(b) Preliminary Approval. The Planning Director shall submit the <br /> preliminary plan to the City Engineer for review and then present <br /> it to the Planning Commission together with their comments and <br /> recommendations. The Planning Commission shall set a date for <br /> consideration of the plan and shall notify by regular mail the <br /> applicant and all adjacent property owners within 500 feet of the <br /> proposed subdivision of the date and place of the meeting. <br /> <br />The Planning Commission shall, by record vote, approve or disap- <br />prove the preliminary plan as submitted or as modified to meet <br />recommendations. If the preliminary plan is approved, the appli- <br />cant may proceed with improvement plans and the plat. If the <br />preliminary plan is disapproved, the action shall be final unless <br />the applicant appeals the decision to City Council within ten <br />days. <br /> <br />4 <br /> <br /> <br />
