Section 4. Notwithstanding the other provisions contained <br />in this ordinance and in consideration of the Collective Bargaining <br />Agreement referred to above, in addition to the salary specified <br />herein, any sworn personnel who are exempt from representation by the <br />recognized bargaining unit shall be entitled to any and all benefits <br />afforded the members of such bargaining unit. Such provision shall <br />apply to the Excutive Assistant Chief and the Chief of Fire save for <br />overtime benefits to which the Chief of Fire shall not be entitled. <br /> Section 5. It is found and determined that all formal <br />actions of this Council concerning and relating to the passage of this <br />Ordinance were adopted in an open meeting of this Council and that all <br />such deliberations of this Council and any of its committees that <br />resulted in such formal action were in meetings held in compliance <br />with all legal requirements. <br /> Section 6. That this Ordinance is hereby declared to be an <br />emergency measure for the reasons set forth in the preamble hereof and <br />provided it receives the affirmative vote of two--thirds of all members <br />elected to Council, it shall take effect and be in force immediately <br />upon its adoption and approval by the Mayor; otherwise, it shall take <br />effect and be in force after the earliest period allowed by law. <br /> <br />ADOPTED: <br /> <br />lqc°q <br /> <br /> <br />
