ORDINANCE NO. 17-90 <br /> <br />BY: Boscia, Gallagher, Gazzana, <br />George, Graham, Roth, Smith <br /> <br />providing <br />with the <br />therefore, <br /> <br /> AN EMERGENCY ORDINANCE amending Section 915.02 of the <br />Streets and Public Services code of the Codified Ordinances of the <br />City of Lakwood relating to Homestead Exemptions in water rates. <br /> WHEREAS, a Momestead Exemption establishing a minimum <br />service and consumption charge for water to persons 65 years of age or <br />older and to permanently or totally disabled persons is appropriate <br />and in the public interest, and <br /> WHEREAS, based on inflation and other factors, it is <br /> appropriate that the standard for such exemption be reviewed from time <br /> to time, and <br /> WHEREAS, the Cuyahoga County Homestead Exemption on real <br /> estate taxes has recently been increased to $16,500.00, and <br /> WHEREAS, such standard is appropriate in considering the <br /> City's water rate Homestead Exemption, and <br /> WHEREAS, this ordinance constitutes an emergency measure <br /> for the health, safety and welfare of our citizens along <br /> usual daily operation of a municipal department; now, <br /> <br /> BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> Section 1. That Section 915.02 of the Streets ~nd Public <br />Services code of the Codified Ordinances of the City of La~ewood, now <br />reading as follows: <br /> <br /> 915.02 HOMESTEAD EXEMPTION. <br /> The Director of Public Works is hereby authorized <br /> and directed to establish a special homestead <br /> exemption, effective March 1, 1987, whereby a <br /> minimum service and consumption charge shall be <br /> made to homesteads owned by persons sixty-five <br /> years of ~ge or older or by a permanently or <br /> totally disabled person, provided that such <br /> person's total income is less than fifteen thousand <br /> dollars ($15,000) annually. The minimum charge for <br /> the first 1,000 cubic feet of water or less used by <br /> each homestead during each one or three-month <br /> billing period shall be twelve dollars and ninety- <br /> three cents ($12.93) beginning March 1, 1989. <br /> All water used in excess of 1,000 cubic feet during <br /> each one or three-month billing period shall cost <br /> 129.3 cents ($1.293) per 100 cubic feet beginning <br /> March 1, 1989. <br /> be and the same is hereby repealed and amended to read as follows: <br /> 915.02 HOMESTEAD EXEMPTION. <br /> (a) The Director of Public Works is hereby <br /> authorized and directed to establish a special <br /> homestead exemption, effective March 1, 1987, <br /> whereby a minimum service and consumption charge <br /> shall be made to homesteads owned by persons sixty- <br /> five years of age or older or by a permanently or <br /> totally disabled person, provided that such <br /> person's total income is less than a certain dollar <br /> amount established by resolution of Council from <br /> time to time.
