deliver to RedeveloPer a fee owner's title insurance policy <br />(the "Title Policy") for the non-public purpose portion of each <br />Redevelopment Property, to be paid for by the Redeveloper in <br />the amount of the Purchase Price allocated to such parcel (See <br />Section 2). The Title Policy shall be issued by a responsible <br />title insurance company authorized to do business in the State <br />~f Ohio and approved by Redeveloper (the "Title Insurer"), <br />insuring good and marketable fee simple title to such portion <br />of the Redevelopment Property, free and clear of all liens, <br />reservations, encumbrances and exceptions other than Permitted <br />Exceptions. The'form of the Title Policy and the company <br />issuing the same shall be acceptable to Redeveloper's Mortgagee <br />(as hereinafter defined). <br /> <br /> (h) Survey~ <br /> <br /> Within ninety (90)'days after the execution of this <br />Agreement, the City shall provide'to Redeveloper at <br />Redeveloper's expense a current area and boundary survey of <br />each Redevelopment Property comprising the Project Area, <br />certified to Redeveloper, Redeveloper's Mortgagee (if then <br />known), and the Title Insurer by a registered public surveyor <br />and professional engineer selected by the City, showing the <br />location and extent of all recorded easements and <br />rights-of-way, all visible structures and improvements, and <br />being otherwise sufficient for purposes of the issuance of the <br />Title Policy, with deletion of all standard exceptions to title <br />which such a current survey would show.
