1. AGREEMENT TO BUY AND SELL. Sellers, under threat <br />of eminent domain, agree to sell and convey to Buyer and Buyer <br />agrees to buy and take title, under the terms and conditions and <br />conditions set forth below, to all of Sellers' right, title, <br /> <br />estate and interest in and to <br />Exhibit "A", together with <br /> <br />located thereon (the "Real <br />rights, <br /> <br /> the real property described in <br />all buildings and improvements <br />Property,') and all appurtenant <br /> <br /> privileges and easements belonging thereto, together <br />with all of Sellers' .right, title, estate and interest in and to <br />the followingl <br /> <br /> Sellers shall have the right to remove from the <br />property, after tenants have vacated the premises, the stoves, <br />refrigerators, space heaters, hot water tanks, and such other <br />property as the parties may agree upon. <br /> <br /> 2. pURCHASE PRICE. The purchase price for the <br />Property shall be EIGHTY ~EIGHT THOUSAND (88,000) DOLLARS. <br /> <br /> 3. ACCEPTANCE OF PROPERTY. Sellers warrant and <br />represent that the only material damage, defects, inoperable or <br />unsafe conditions affecting the property known to Sellers are <br />likewise known to Buyer asa result of Buyer's inspection of the <br />property. Buyer accepts the property in its present condition. <br /> <br /> 4. a) DEED. Sellers shall furnish a general warranty <br />deed conveying marketable title to the Property to Buyer, <br />subject at the time of title transfer to: (1) taxes and <br />assessments which are a lien, but not yet due and payable, and <br />'(2) such other encumbrances, reservations and exceptions, if <br />any, as are permitted in the title guarantee described below. <br /> <br /> b) TITLE INSURANCE. Sellers shall provide an <br />owners policy Title Insurance (ALTA Form B) at the time of title <br />transfer with Schedule B general and printed exceptions deleted <br /> <br /> <br />
