ORDINANCE NO. <br /> <br />100-91 <br /> <br />Gallagher, Gazzana, George, <br /> Graham, Roth, Smith <br /> <br /> AN EMERGENCY'ORDINANCE, authorizing and directing the Mayor, .on <br />behalf of the City of Lakewood,'to-enter into a contract with society . <br />CorporatiOn (society) and.Lakewood Associates, Incorporated (LAI): for <br />the sale and exchange of real'prOperty Permanent Parcel ~number 314-04-024 <br />(Municipal Parking Lot) located On Warren Road in the City. of Lakewood <br />and real' property permanent Parcel numbers ~14-04-056, 012'and 011 <br />(SOcietY.Parking Lot') located south of Detroit AvenUe and east of <br />Victoria Avenue in the' City.of Lakewood, and real property located at <br />1435 Warren Road (Old Rost office), Permanent Parcel Number 314-04-0'23, <br />purchase a leasehold and settle a claim for business relocation expenses <br />of the 'Society for. relocation of its branch office located at 14903. <br />Detroit Avenue, Lakewood, Ohio. <br /> <br /> WHEREAS, the City has enacted ordinance Number 1-91 and entered <br /> into a development agreement with LAI for the development of the Lakewood <br /> City Center Project which gives LAI the right to'buy the Old Post office <br /> at the city's cost and to purchase the adjacent lot at market value, and- <br /> <br /> WHEREAS', SOciety has a. branch office' at 14903 Detroit Avenue, <br /> Lakewood~ Ohio which'is sCheduled t° be demOlished by the~City for the <br /> Lakewood city Center Project'a'nd has a lease and therefore is entitled to <br /> reasonable compensation and relocation costs, and <br /> <br /> WHEREAS, Society owns a Parking'lot known as Permanent Parcel <br /> Numbers.314-04-056, 012 and 011 which is adjacent to its leasehold and <br /> the site of. its Automated'Teller Machine (ATM) which parking lot must be <br /> acquired by the.City aS~a part of the Lakewood City Center Project <br />previously approved in Ordinance 1"~91, and <br /> <br /> WHEREAS, it'is the desire of. the developer LAI, the City and <br /> society to relocate Society's branch office.in the Lakewood City Center <br /> Project and to immediately move Society's ATM to a temporary site so that <br /> Victoria Avenue. can be.closed at 'Detroit Avenue, and <br /> <br /> WHEREAS, the City has enacted Ordinance Number 97-91 <br /> authorizing'the purchase of the Old Post Office property for the <br /> Lakewood City Center Project, which property 'is well suited to the needs <br /> of society, which desires to purchase'the property from the City and LAI <br /> together with the Municipal Parking Lot adjacent to it; and <br /> <br /> WHEREAS, the'City, Society and LAI have entered into an <br />agreement memorialized in a memorandum of understanding to bring about <br />the relocation of Society's branch office to the Old Post Office site and <br />for the purchaseof Society's leasehold and the Society Parking Lot and <br />for relocation expenses which memorandum is set forth in a letter <br />attached hereto as Exhibit "A", and incorporated herein by reference; and <br /> <br /> WHEREAS, LAI has agreed to purchase the Old Post office, for <br />$180,000 from the City subject to authorization by Council and the Mayor <br />by duly adopted ordinance and final approval of the purchase agreement by <br />the Law Director which purchase and sale has been consented to by LAI <br />which has waived its right to the propertY; and <br /> <br /> WHEREAS, approval of the plans of both society and LAI for the <br />Lakewood City Center Project have been approved by the Architectural <br />Review Board at the December 9, 1991 meetings; and <br /> <br /> WHEREAS, the purchase, sale and exchange of properties and <br />settlement of relocation claims proposed in Exhibit "A" are essential .to <br />the proposed LakeWood City Center Project and muSt be approved if the <br />project is to proceed in a timely manner; and <br /> <br /> WHEREAS, this ordinance Constitutes an emergency measure <br />.providing for the immediate preservation of the public health, safety and <br /> welfare and for the usual daily operation of a municipal department to <br /> wit: the Department of Public Works cannot begin to grade the Lakewood <br /> city Center Project site until Victoria Avenue is closed at Detroit <br /> Avenue which necessitates the relocation of society's ATM.from the <br /> parking lot to be conveyed to the City to 'a temporary location until a <br /> new bank branch is ready for occupancy, which is contingent upon Council <br /> approval of the purchase of Society's land which is an element of an <br /> agreement negotiated between the City, society and LAI, now therefore <br /> <br /> <br />
