BE ET ORDAINED BY THE CITY OF LAKEWOOD~ STATE OF OHIO: <br /> <br /> Section 1. That the Mayor on behalf of'the City of Lakewo0d <br />be and he is hereby authorized..and directed to enter 'into contracts <br />with Society CorpOration (Society) and Lakewood Associates, Incorporated' <br />(LAI) as outlined in Exhibit "A" attached hereto and incorporated by' <br />reference with such. terms and~provisions as are acceptable to the <br />Director of Law to protect the public interest, and the Mayor is further· <br />authorized and directed to execute all necessary deeds, conveyances and <br />other, documentS required to effectUate the sales, exchanges and transfers <br />and settlement of claims outlined in Exhibit "A"·. <br /> <br /> Section 2.~ That~pursuant to the terms of the aforementioned <br />Exhibit "A'!, .and formal documents to.belapproved by the Director of Law, <br />the City hereby.formally .approves the sale and exchange of real property· <br />located in the.city of Lakewood at, 1435.Warren Road (Old Post Office) <br />Permanent Parcel Number 314-04~023, Permanent Parcel Number 314-04-g24 <br />(Municipal Parking Lot)~ and Permanent Parcel Numbers 314-056, 012, 01t <br />(Society Parking Lot) hereinabove described, and approves and ratifies <br />the actions of the Mayor as of this date and authorizes the Acting <br />Finance Director or Finance Director to expend fUnds in an amount not to <br />exceed Fifteen ThoUsand ($15,000) Dollars.to Society or. its designee for <br />expenses of the·temporary relocation of its Automated Teller Machine <br />(ATM) and.to expend any funds necessary for the completion of these' , <br />transactions including~closing costs, title work, conveyance and· <br />recording fees. <br /> <br /> Section 3. It is found and determined that all fOrmal actions <br /> of this Council concerning and~relating.to the passage of this ordinance <br /> were adopted in an open,meeting of this COuncil, and that all such <br /> deliberations 'of this council and of any of its Committees that resulted <br /> in such formal action were in meetings open to the public in compliance <br /> with all legal ~requirements <br /> <br /> Section 4. That this Ordinance is'hereby declared to be an <br /> emergency measure ·necessary for the immediate preServation of the public <br /> peace, property, health, safety and. welfare in the City for the reasons <br /> stated in the preamble hereof and provided it receives the affirmative <br /> vote of two-thirdS of all members elected to Council, it shall take <br /> effect and be in force immediately upon 'its' adoption and approval bY the <br /> Mayor; otherwise it shall take effect and be <br /> , - ~~arliest <br />'period allowed by law. <br /> <br /> Adopted: <br /> <br />~ CLERK ' <br /> <br /> <br />
