Monroe, his heirs or assigns, <br /> ¢ <br /> <br />(hereinafter referred to as "Seller") and the City of Lakewood, <br />a Municipal Corporation, 12650 De'troit Avenue, <br /> <br />(hereinafter referred to as "Buyer")..~ <br /> <br />buy <br />Lakewood, <br />"Property" <br />attached <br />with all <br />property <br /> <br />Lakewood, Ohio <br /> <br /> WITNES SETH: <br /> <br /> WHEREAS, Seller desires to sell and Buyer desires to <br />certain real property 'located at 14895-903 Detroit AvenUe, <br /> <br /> NOW, THEREFORE, <br /> <br />promises, covenants and <br />other good and valuable <br /> <br /> in consideration of the mutual <br />agreements contained herein and for <br /> <br /> consideration, the receipt and <br /> <br />Buyer, City of Lakewood,. is desirous of obtaining said property <br />for a particular public purpose. The City of Lakewood has <br />notified the Sellers of its intention to take said property in <br />accordance with applicable law if Sellers refuse to negotiate a <br />Purchase Agreement for the property.. Therefore, under the <br />threat of eminent domain proceedings by the city, Sellers agree <br />to sell the subject property to the Buyer ~upon the terms and <br />conditions contained herein. Except. for the City's intention to <br />take the property under its power of eminent domain for a public <br />purpose Sellers would not be desirous of selling the property at <br />this time. <br /> <br />Ohio, all such property referred to herein as the <br />which is more particularly described in Exhibit "A" <br />hereto and incorporated by. reference herein, together <br />Seller's right, title and interest in and to the <br />described which Seller may have in said property.
