ORDINANCE NO. 7-92 <br /> <br />BY:Boscia, Gallagher, George, <br />Gibbons, Roth, Seelie, Smith <br /> <br /> AN EMERGENCY ordinance to vacate a portion of the public <br />right-of-way situated on Victoria Avenue, in the city of Lakewood, <br />Ohio. <br /> WHEREAS, on November 18, 1991, Council adopted Resolution <br />No. 6662-91 declaring its intent to vacate a portion of the public <br />right-of-way situated on victoria Avenue, and <br /> WHEREAS, notice of the adoption of the above Resolution No. <br />6662-91 has been served upon the owners of all of the properties <br />abutting Victoria Avenue affected by said Resolution, notifying said <br />property owners of the time and place at which objections could be <br />heard before the Board of Revision of Assessments, and <br /> WHEREAS, on January 7, 1992, the Board of Revision of <br />Assessments approved vacation of a portion of the public right-of-way <br />of Victoria Avenue hereinafter more particularly described in accord- <br />ance with the provisions of Article XIV, Section 28 of the Amended <br />Charter of the City of Lakewood, and <br /> <br /> WHEREAS, Council is satisfied that there is good cause for <br />vacating a portion of the right-of-way of Victoria Avenue and that it <br />will not be detrimental to the general interest of the public, and <br /> WHEREAS, this ordinance constitutes an emergency measure <br />providing for the immediate preservation of the public health, safety <br />and welfare, and for the usual daily operation of a municipal depart- <br />ment; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br />the <br /> <br /> Section 1. That the following described property be and <br />same is hereby vacated: <br /> <br />SITUATED in the City of Lakewood, County of Cuya- <br />hoga and State of Ohio and known as being part of <br />Original Rockport Township~ Section No. 22 and <br />further described as follows~ <br /> <br />Beginning at a point in the southerly right-of-way <br />line of Detroit Avenue (66 feet wide) at the <br />northwesterly corner of a parcel of land conveyed <br />to the Lakewood-Warren-Detroit Partnership, Ltd., <br />recorded in Volume 84-6217, Page 23 of Cuyahoga <br />County Records; <br /> <br />Thence South 84 degrees 36' 10" West, along said <br />southerly right-of-way line, 176.28 feet to a <br />point of intersection with the easterly right-of- <br />way line of Victoria Avenue (50 feet wide) and the <br />principle place of beginning of the portion of <br />right-of-way herein intended to be vacated; <br /> <br />Course I: Thence South 0 degrees 17' 55" East, <br />465.18 feet to a point; <br /> <br />Course II: Thence South 89 degrees 30' 12" West, <br />50.00 feet to a point; <br /> <br />Course III: Thence North 0 degrees 17' 55" West, <br />460.90 feet to a point in the southerly right-of- <br />way line of Detroit Avenue; <br /> <br /> <br />
