ORDINANCE NO. 7-92 BY:Boscia, Gallagher, George, Gibbons, Roth, Seelie, Smith AN EMERGENCY ordinance to vacate a portion of the public right-of-way situated on Victoria Avenue, in the city of Lakewood, Ohio. WHEREAS, on November 18, 1991, Council adopted Resolution No. 6662-91 declaring its intent to vacate a portion of the public right-of-way situated on victoria Avenue, and WHEREAS, notice of the adoption of the above Resolution No. 6662-91 has been served upon the owners of all of the properties abutting Victoria Avenue affected by said Resolution, notifying said property owners of the time and place at which objections could be heard before the Board of Revision of Assessments, and WHEREAS, on January 7, 1992, the Board of Revision of Assessments approved vacation of a portion of the public right-of-way of Victoria Avenue hereinafter more particularly described in accord- ance with the provisions of Article XIV, Section 28 of the Amended Charter of the City of Lakewood, and WHEREAS, Council is satisfied that there is good cause for vacating a portion of the right-of-way of Victoria Avenue and that it will not be detrimental to the general interest of the public, and WHEREAS, this ordinance constitutes an emergency measure providing for the immediate preservation of the public health, safety and welfare, and for the usual daily operation of a municipal depart- ment; now, therefore, BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: the Section 1. That the following described property be and same is hereby vacated: SITUATED in the City of Lakewood, County of Cuya- hoga and State of Ohio and known as being part of Original Rockport Township~ Section No. 22 and further described as follows~ Beginning at a point in the southerly right-of-way line of Detroit Avenue (66 feet wide) at the northwesterly corner of a parcel of land conveyed to the Lakewood-Warren-Detroit Partnership, Ltd., recorded in Volume 84-6217, Page 23 of Cuyahoga County Records; Thence South 84 degrees 36' 10" West, along said southerly right-of-way line, 176.28 feet to a point of intersection with the easterly right-of- way line of Victoria Avenue (50 feet wide) and the principle place of beginning of the portion of right-of-way herein intended to be vacated; Course I: Thence South 0 degrees 17' 55" East, 465.18 feet to a point; Course II: Thence South 89 degrees 30' 12" West, 50.00 feet to a point; Course III: Thence North 0 degrees 17' 55" West, 460.90 feet to a point in the southerly right-of- way line of Detroit Avenue;
