7. Funds for the STATE's obligation for this PROGRAH shall be released to the GRANTEE <br />after the execution, of an Agreement between the STATE and the GRANTEE. No money will <br />be made available prior to the full execution of this Agreement. The GRANTE~sha11 nc <br />make expenditures for items pertaining to this education grant until notified by the <br />STATE to proceed. The STATE shall not be responsible for any cost incurred by the <br />~RANTEE prior to'the ~RANTEE being notified to proceed. <br /> <br />8. The GRANTEE agrees to submit a complete and accurate accounting of expenditures <br />under this Agreement to the D/v/sion of Vatercraft within 30 days after completion of <br />the boating education PROGRAH. If any portion of the grant, as above specified, <br />remains unexpended at the completion of the PROGRAH, or if an audit discloses an <br />unauthorized expenditure of STATE funds, said balance shall be returned i~mediately by <br />the GRANTEE to the STATE for redeposit in the Waterways Safety Fund. <br /> <br />9. Termination of the PROGRA~ before its completion as originally proposed by the <br />GRARTEE entitles the STATE to reimbursement of the STATE's contribution at a prorated <br />amount for non-expendable boating equipment and supplies purchased under this <br />Agreement. This prorated amount depends on the duration of the P~OGR~w as outlined in <br />Exhibit A and the life span of the equipment as outlined in Exhibit C. This would <br />include the return, of any boats and equipment not being used in an ongoing boatin~ <br />safety education program. <br /> <br />10. The STATE reserves the right to approve scripts, personnel, and all other program <br />or project related parameters. In addition, the STATE may use all artwork, <br />photography, texts, or other materials and ideas developed in association with the <br />grant~ All non-expendable equipment items (projectors, boats, etc.) purchased with <br />grant monies remain the property of the STATE for a time period not' to exceed the <br />reasonable life expectancy of the equipment as outlined in Exhibit C. An~ equipment <br />purchased must be dedicated to a continuing program of boating safety education and <br />will remain in the care of the GRANTEE. All equipment purchased for the PROGR~W has an <br />agreed upon life expectancy as outlined in Exhibit C. During this life span, the <br />GRANTEE shall not sell, change, or alter the intended use of this equipment. Should <br />any equipment purchased by the STATE for this PROGRAM be lost, stolen, or destroyed <br />during its agreed upon life span, the GRANTEE shall be responsible for its <br />replacement. <br /> <br />11. Insurance coverage on equipment purchased through this ~rant i.s mandatory. Th, <br />GRANTEE must provide proof of this insurance to the STATE. The STATE must be notifi~ <br />by the Insurance Company in writing 60 days prior to the termination of any coverage. <br /> <br />AGREEMENT: PAGE 2 <br /> <br /> <br />
