12. Political Subdivisions must attach an approved ordinance or resolution, ~xhibit O, authorizing the Political Subdivision to enter into agreement w~th the Division of ~atercraft for the project. Non-Political Subdivisions must attach a notarized letter of .commitment, Exhibit D, officially stating the organization's willingness to enter into agreement with the Division of Watercraft for the project. 13. All non-expendable equipment items and printed materials purchased directly with grant moneys must be permanently marked with th~ following: 'Funded through a grant from the Ohio Department of Natural Resources, Division of Watercraft." 14. The GRANTEE agrees to maintain a boating safety program in accordance with the PROGRAH as submitted and approved in the Application for Assistance ~Exhibit A1. Should the program as proposed cease to e~ist, the STATE reserves the right either to receive reimbursement for the then present market value of the property, or, at /ts sole option, to have the property returned to the STATE. 15. The parties hereto agree that in the event the STATE, acting through the Chief of the Division of Watercraft, determines that the ~ttFTEE has failed to comply with any terms and conditions of the Agreement, the STATE may at such time terminate this Agreement by sending written notice of such termination and the reasons therefore to the GRLNT~-. Upon such termination, the Gq~M~EE shall immediately return to the STATE any and all moneys contributed by the STATE under the terms of this Agreement which have not as of the date of the termination been legitimately expended by the GRANTEE. 16. In performance of this contract, the G~rTEE agrees as follows: a. The GI~M~E will not discriminate against any employee or applicant for employment because of race, color, religion, national origin, age (40-70 years), handicap, ancestry, or sex. The GRANTEE will take affirmative action to ensure that applicants are employed, and employees are treated during employment, without regard to their race, color, religion, national origin, age (40-70 years), handicap, ancestry, or sex. Such action shall include, but is not limited to, the following: employment, upgrading, demotion, or transfer; recruitment or recruitment advertising; layoff or termination; rates of pay or other forms of compensation; and selection for training, including apprenticeship. The GRANTEE agrees to post in conspicuous places, available to employees and applicants for employment, notices to be provided by the DEPARTWTJ~ setting forth the provisions of this nondiscrimination clause.
