URDINANCE NO. 83-92 BY: Boscia, Gallagher, George, Gibbons, Roth, Seelie, Smith AN EMERGENCY ORDINANCE to amend Section 913.U6 (d)(2) of the Wastewater Disposal Code of the Codified Ordinances of the city of Lakewood relating to regulation of the use of municipal and private sewers and drains and the discharge of waters and waste into the pUblic sewer system. WHEREAS,'the United States Environmental Protection Agency requires municipalities who accept design and construction grants to assure that sewers are used in a proper manner in compliance with applicable federal regulations and with good engineering practices; and WHEREAS, pursuant to Ordinance 59-78 adopted july 5, 1978, the City provided certain assurance of compliance to the Federal Environmental Protection Agency in connection with the City's application for its Step 2 Grant and the proposed modification of the wastewaSer treatment plant; and WHEREAS, the Environmental Protection Agency has mandated certain changes in our existing Pretreatment Program to bring the city into compliance with new Pretreatment Standards and this council determines it to be in the best interest of the City to enact such legislation to incorporate the new regulations into our existing sewer Use Program; and WHEREAS, failure to comply with the revisions to the pretreatment regulations may result in an enforcement action issued by the Ohio EPA; and WHEREAS, an emergency exists to provide for the usual daily operation of a municipal department arising 'from the necessity of complying with the Environmental Protection Agency's modifications of the approved Pretreatment Program and the immediate preservation of the public peace, property, health, safety and welfare in the City.
