JUVENILE Committee on 5/5/93. <br /> <br />ORDINANCE NO. 30-93 <br /> <br />BY: <br /> <br />Boscia, George, Gibbons, <br />Roth, Seelie, Smith <br /> <br /> AN EMERGENCY ORDINANCE to amend Sections 1721.02, 1721.04 <br />and 1721.05 of the Sanitary Code of the Codified Ordinances of the <br />City of Lakewood to establish licensing fees for public swimming <br />pools, public spas and special use pools in accordance with rules <br />promulgated by the Ohio Department of Health. <br /> <br /> WHEREAS, the City requires any operator of a public or <br />private swimming pool to obtain a license from the City, and <br /> <br /> WHEREAS, the Ohio Department of Health has promulgated <br />rules affecting the licensing of public swimming pools, spas and <br />special use pools, and <br /> <br /> WHEREAS, the City of Lakewood, Division of Health, is <br />required to issue said licenses in cOnformity with those rules, and <br /> <br /> WHEREAS, this ordinance provides for the preservation of <br />the public health, safety and welfare, and for the usual daily <br />operation of a municipal department in 'that Ohio law requires the <br />licensing of public pools, public spas, and special use pools in <br />accordance with rules promulgated by the State Department of <br />Health; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That Section 1721.02 of the Sanitary Code of <br />the Codified Ordinances of the City of Lakewood, be amended by the <br />enactment of new subsections (g) and (h) to read as follows: <br /> <br />1721.02 DEFINITIONS. <br /> <br />(b) . . <br /> <br />(d) . <br /> <br />(e) . . . <br /> <br />(f) · <br /> <br />(g) <br /> <br />"Public spa" means any public swimming pool that is <br />typically operated as a smaller, higher temperature <br />pool for recreational or non-medical uses. <br /> <br />1. "Smaller" means less than five thousand gallons <br /> in volume. <br />2. "Higher temperature" means greater than ninety <br /> degrees Fahrenheit. <br /> <br />(h) <br /> <br />"Special use pool" means a public swimming pool <br />containing flume slides, wave generating equipment <br />or other special features that necessitate different <br />design and safety requirement. "Special use pool" <br />does not include any water slide or wave generating <br />pool at a public amusement area which is licensed <br />and inspected by the Ohio Department of Agriculture, <br />pursuant to R.C. Sections 1711.50 to 1711.57. As <br />used in this paragraph: <br /> <br />"Special features" includes, but is not limited <br />to, a flume slide, a playground-type slide, wave <br />generating equipment, or a raindrop fountain or <br />other water attraction. <br /> <br /> <br />
