Section 3. That section 1721.05 of the Sanitary Code of <br />the Codified Ordinances of the City of Lakewood now reading as <br />follows: , <br /> <br />1721.05 LICENSE TO OPERATE; TRANSFERABILITY; EFFECTIVE <br /> PERIOD. <br /> <br /> No person shall operate or maintain a swimming pool until <br />a license therefore has been issued by the Commissioner of Health. <br />The license for a family swimming pool shall be issued for an <br />indefinite period but shall not be transferable as to person or <br />location. The license for a public swimming pool shall be issued <br />yearly, and a new license shall be secured on or before May 1 of <br />each year, which will permit operation or maintenance until the <br />following APril 30. All licenses shall be in writing and shall <br />state the conditions thereof and the term for which the license is <br />granted. It shall be unlawful for any person to conduct, operate, <br />maintain or manage any swimming pool without complying with the <br />requirements of this chapter, and the Divisions of Public Health <br />and Building Inspection are charged with the enforcement of the <br />provisions hereof. <br /> <br />shall be and the same is hereby amended to read as follows: <br /> <br /> 1721.05 LICENSE TO OPERATE; TRANSFERABILITY; EFFECTIVE <br /> PERIOD. <br /> <br /> No person shall operate or maintain a swimming pool until <br />a license therefore has been issued by the Commissioner of Health. <br />The license for a family swimming pool shall be issued for an <br />indefinite period but shall not'be transferable as to person or <br />location. The license for .a public swimming pool shall be issued <br />yearly, and a new l~cense shall be secured on or before June 1 of <br />each year, which Will permit operation or maintenance until the <br />last day of the following May. All licenses shall be in writing <br />and shall state the conditions thereof and the term for which the <br />license is granted. It shall be unlawful for any person to <br />conduct, operate, maintain or manage any swimming pool without <br />complying with the requirements of this chapter, and the Divisions <br />of Public Health and Building Inspection are charged with the <br />enforcement of the provisions hereof. <br /> <br /> Section 4. It is found and determined that all formal <br /> actions of this Council concerning and relating to the passage of <br /> this ordinance were adopted in an open meeting of this Council, and <br /> that all such deliberations of this Council and of any of its <br /> committees that resulted in such formal action were in meetings <br /> open to the public in compliance with all legal requirements. <br /> <br /> Section 5. That this ordinance is hereby declared to be <br />an emergency measure for the reasons stated in the preamble hereof <br />and provided it receives the affirmative vote of two-thirds <br />of all members elected to Council, it shall take effect and be in <br />force immediately upon its adoption and approval by the Mayor; <br />otherwise, it shall take effect and be in force after the earliest <br />period allowed by law. <br /> <br />Approved :. ~ /~ /~ <br /> <br />PR~S IDENT~ <br /> <br />CLERK <br /> <br /> <br />
