PLACED ON 1st Reading ~ Referred to <br />FINANCE COMMITTEE on 2/21/95. <br />PLACED ON Zm~ g~ $/6/95. <br /> <br />ORDINANCE NO. 5-95 BY: Boscia, Flannery, <br /> George, Roth, Seelie, Smith <br /> AN ORDINANCE amending Sections 111.01 and 111.02 of <br />the Administrative Code relating to procedures for the awarding <br />of contracts, and providing for separate resolution of council to <br />authorize exceeding line item limits in previously adopted con- <br />tracting ordinances. <br /> <br /> WHEREAS, it has long been the policy of Lakewood City <br />Council to adopt general contracting ordinances setting forth the <br />broad categories of contracts to be entered into by the various <br />departments of the city as set forth in more detail in the annual <br />budget; and <br /> <br /> WHEREAS, the Administrative Code provides for the process <br />and procedures for the approval of contracts entered into by the <br />city for public improvements and work and repairs as well as the <br />procurement of materials and supplies and professional services <br />necessary., for the usual and customary operations of the city; and <br /> WHEREAS, in order to provide greater oversight by Council, <br />its Finance Committee, has adopted a policy of trust but verify <br />which has required the city departments to propose several con- <br />tracting ordinances setting forth categories of contracts to be <br />let in the forthcoming year divided into line items with dollar <br />spending limits; and <br /> <br /> WHEREAS, Council's Public Works Committee and Finance Com- <br />mittee have found that they can provide oversight control while' <br />permitting the city departments the flexibility necessary to <br />conduct the city's business without unreasonable delay by author- <br />izing contracting in amounts not to exceed line item totals <br />except when specifically authorized by separate resolution of <br />Council; and <br /> <br /> WHEREAS, the codification of the.uPdated cQntracts approval <br />process will facilitate timely advertising for bids and proposals <br />and the efficient letting of city contracts. <br /> <br /> NOW, THEREFORE BE IT ORDAINEDBY THE CITY OF I2%KEWOOD, STATE <br />OF OHIO <br /> <br /> Section 1o That section 111.01 of the Administrative <br />Code, now reading as follows: <br /> <br /> 111.01 DEPARTMENTAL PUBLIC IMPROVEMENT CONTRACTS <br />(a) Contracts for public improvement~ and work and repairs <br />with respect to public improvements shall be awarded by the <br />Director of Public Works upon approval by Council. Adoption <br />of an ordinance or resolution authorizing the preparation of <br />plans or specifications, an ordinance or resolution author- <br />izing the advertising of request for bids (where bidding <br />shall be required) or any other ordinance or resolution <br />which authorizes or approves the award of a contract, shall <br />constitute the approval of Council required by Section 3 of <br />Article V of the Charter and this section. <br /> <br />(b) . . . <br /> <br /> <br />
