<br />( <br /> <br />( <br /> <br />( <br /> <br />i. provide the Lead Entity with the documentation <br />(in a timely manner) that it may require to <br />document compliance with the HOME Program <br />regulations as applicable to the Program; and <br /> <br />ii. give written notification to the Lead Entity <br />of noncompliance by the City or any Eligible <br />Borrower with any provision of such Eligible <br />Borrower's Homebuyer Agreement upon becoming <br />aware of such noncompliance, and, if <br />compliance with such provision is the <br />responsibility of the City, institute <br />corrective action, ànd, if compliance with <br />such provision is not the responsibility of <br />the City, monitor any corrective action taken <br />by the party responsible for compliance with <br />such provision. <br /> <br />6. GENERAL PROVISIONS. <br /> <br />A. Entire Understandinq. This Agreement. constitutes <br />the entire understanding and agreement of the parties and shall not <br />be altered or amended except by a writing executed by the parties <br />hereto. <br /> <br />B. Term of Aqreement. This Agreement shall take effect <br />on the date hereof and be in effect through and including the <br />earlier to occur of (i) the date that the City notifies the <br />Consortium in writing that the committed Amount of HOME Funds has <br />been disbursed or (ii) the last day of the Fiscal Year. <br /> <br />C. Bindinq Aqreement. This Agreement is binding upon <br />and inures to the benefit of the parties hereto, their respective <br />successors, and assigns. <br /> <br />D. <br />Agreement to <br />Lead Entity. <br /> <br />Assiqnment. The City shall not assign this <br />any other party without the written consent of the <br /> <br />E. Execution Counterparts. This Agreement may be <br />executed in several counterparts, each of which shall be regarded <br />as an original and all of which shall constitute but one and the <br />same Agreement. <br /> <br />F. Severabilitv. In case any section or provision of <br />the Agreement, or any covenant, stipulation, obligation, agreement, <br />act, or action, or part thereof made, assumed, entered into, or <br />taken thereunder or any application thereof, is for any reason held <br />to be illegal or invalid, such illegality or invalidity shall not <br />affect the remainder thereof or any other section or provision <br />thereof or any other covenant, stipulation, obligation, agreement, <br /> <br />-5- <br />
