<br />.~ <br />PLACED ON 1st Reading & Referred to <br />FINANCE COMMITTEE 11/20/95. <br />PLACED ON 2nd Reading 12/4/95. <br /> <br />ORDINANCE NO 75-95 <br /> <br />BY' Boscia, Flannery, George, <br />Giboons, Roth, Seeli~, Smith <br /> <br />AN EMERGENCY ORDINANCE to amend section 902.10 of theStreets and <br />Public Service$ Code of the Codified Ordinances of the City of Lakewood to <br />create the Wastewater Collections Systems Fund and the Wastewater <br />Treatment Fund. and renaming the Sewer and Wastewoter Facilities <br />Improvement Fund the Wastewater Improvement Fund <br /> <br />WHEREAS. there is 0 compelling governmental interest to establish these <br />funds to proVide separate financial informeJtion that will demonstrate <br />accountability and stewardship to each operation and to provide information <br />for evaluating operational performance of the wastewater collections and <br />wa'Stewater treatment functions, and <br /> <br />WHEREAS. the City currently administers these services through two <br />separate divisions; and <br /> <br />WHEREAS, this ordinance constitutes an emergency measure providing for <br />the usual daily operation of a municipal department in that creation of two <br />separate funds will allow the City to provide more accurate information when <br />deveioping fee scheduies for wastewater collection and wastewater <br />treatment; now. therefore, <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br />Section l' That Section 902.10 of the Streets and PUblic Services Code of <br />the Codified Ordinances of the City of Lakewood now reading as follows' <br /> <br />90210 <br /> <br />SEWER AND WASTEWATER FACILITIES iMPROVEMENT FUND; <br />SEWER AND WASTEWATER OPERATION AND MAINTENANCE <br />FUND <br /> <br />(a) All property taxes designated tor wastewater system use and ali of <br />the capitai charges portion of the variable charges shail be kept and <br />maintained In a separate fund in an account hereby designated as the <br />Sewer and Wastewater Facilities Improvement Fund. The revenues from <br />all bonds and notes issued for the acquisition and installment of such <br />system shall accrue to this account and be used for improvement and <br />extension of the wastewater tacilities. <br /> <br />(b) All of the user charges portion of the variable charges shall be kept <br />and'maintained in a separate fund in an account hereby designated as <br />Sewer and Wastewater Operation and Maintenance Fund All operating, <br />maintenance, repair and replacement costs for the wastewater facilities <br />shall be paid from this fund. <br /> <br />Page 1/2 <br />
