Amended to Conform <br />12/18/95 <br /> <br />ORDINANCE NO <br /> <br />77-95 <br /> <br />BY: <br /> <br />Boscia, Flannery, Gibbons, <br />Roth, Seelie, Smith <br /> <br />AN EMERGENCY ORDINANCE amending sections 902.04, 902.05, and <br />913.25 of the Public Services Code of the Codified Ordinances of the City of <br />Lakewood to authorize and direct the Director of Public Works to annually <br />establish monthly sewer rates, establishing an initial sewer rate, and establishing <br />a Homestead exemption for same. <br /> <br />WHEREAS, the current sewer rate is insufficient to allow the Wastewater <br />Treatment Fund and Wastewater Collections System Fund to be self-supporting; <br />and, <br /> <br />WHEREAS, in ordèr to offset the continuing general increases in operating <br />cost of the wastewatèr treatment facilities it is necessary för the City to increase <br />the rates charged to the users of the wastewater disposal system; and <br /> <br />WHEREAS, èxtending a reduction for sewer charges to persons qualifying <br />for Homestead exemption will not greatly effect revenues to the Wastewater <br />Treatment Fund and the Wasfewater Collections System Fund; and <br /> <br />WHEREAS. Chapter 902 of the Codified Ordinances authorizes the City to <br />set sewer rates to distribute the costs of operation and maintenance of the <br />wastewater disposal system and the costs to maintain compliance with <br />applicable standards dnd regulations of the U.s E PA proportionately upon all <br />users of said system; and <br /> <br />WHEREAS, this ordinance constitutes an emergency measure providing for <br />the usual daily operation of a municipal deportment in that it is necessary to <br />providè the Director of Public Wörks the flexibility to adjust sewer rates and <br />billing such charges monthly will improve the revenue stream for the Division of <br />Water and Wastewater Coilections; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO' <br /> <br />Section 1 That section 902.04 of the Public Services Code now reading <br />as follows; <br /> <br />902.04 RATES AND CHARGES <br />(d) Rates and charges for the use and service of the Municipal <br />wastewater disposal system of the City are hereby established. Such <br />charges and rates shall be made against each lot. parcel of land ör <br />premises which may have an active sewer connection with the Municipai <br />wastewater disposal system or which may otherwise dischargè <br />wastewater either directly or indirectly into such system or any part <br />thereof Such charges and rates shall be based upon the quantity of <br />wastewater discharged thereon or therein as such quantity may be <br />measured by wastewater flow meters or the water meter of the Water <br />Dèpdrtment serving such lot, parcel of iand or premises as determinèd by <br />the discretion of the City Engineer. Specific ratès and charges shall be in <br />the amounts provided in subsection (d) hereof Council shall review thèse <br />rates and charges annually no later than December 31 of each year and <br />may adjust such rates and charges, if warranted. <br /> <br />(b) . . . <br /> <br />Pagè 1/3 <br />
