Code of the Codi fled Ordinances of the City of Lakewood in order to regulate <br />the practice of tattooing. <br /> <br /> WHEREAS, the Division of Health for the City of Lakewood, Ohio, has authority <br />to adopt regulations tbr the public healths the prevention or restriction of disease, and the <br />prevention, abatement or suppression of nuisances pursuant to Ohio Revised Code <br />3707.01 and Ohio Revised Code 3709.20 and/or 3709.2 I; and <br /> <br /> WHEREAS, many diseases may be spread through improperly sanitized needles <br />or instruments used in invasive procedures on the human body; and <br /> <br /> WHEREAS, tattooing uses needles and other instruments in invasive procedures <br />on the human body; and <br /> <br /> WHEREAS, this ordinance, is an emergency measure which is necessary for the <br />immediate preservation of the public peace, health and safety in the City of Lakewood, <br />and for the further reason that immediate action is necessary in order to ensure the <br />prevent/on of the communication of any disease through the practice of tattooing; now <br />therefore, <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, <br />STATE OF OHIO <br /> <br /> Section 1. That the Sanitary Code of the Codified Ordinances of the City of <br />Lakewood be and the same are hereby supplemented by enacting nexv Title Nineteen, <br />Chapter 1793, thereof to read as follows: <br /> <br />1793.0t DEFINITIONS. <br /> <br />As used in this Chapter: <br /> <br />(A) The term "Health Commissioner" shall mean the administrative official <br /> charged with the duty of creating policy, and administering the regulations <br /> and laws which promote the health and sanitation of the citizens of the City of <br /> Lakewood. <br /> <br />(B) The term "Health OfficeF' shall mean a duly authorized employee of the <br /> Division of Health for the City of Lakewood. <br /> <br />(C) The term "certificate of inspection" shall mean written approval from the <br /> health officer or his authorized representative that said tattooing establishment <br /> has been inspected and meets all of the terms of this ordinance. <br /> <br />(D)The term "operator" shall mean any individual, firm, company, corporation or <br /> association that owns or operates an establishment where tattooing is <br /> performed and any individual who performs or practices the art of tattooing <br /> on the person of another. <br /> <br />The terms "tattoo", "tattooed" or "tattooing" refer to any method of placing <br />designs, letters, scrolls, figures, symbols or any other marks upon or under thc <br />skin with ink or any other substance resulting in the coloration of the skin by <br />the aid of needles or any other instruments designed to touch or puncture thc <br />skin. <br /> <br />(F) Tattoo "establishment" means the location wherein tattooing is pertbrrned. <br /> <br /> <br />
