Section 9 That Section 1331.08 of the Building Code of the Codified Ordinances <br />of the City of Lakewood. now reading as tbllows: <br /> <br />1331.08 TAMPERING PROHIBITEDi <br /> No person shall, without privilege to do so, knowingly move, deface, damage, destroy <br />or otherwise improperly tamper with a smoke detector required to be installed pursuant to <br />the provisions of this chapter so as to destroy or diminish its effectiveness or availability <br />for its intended purpose. <br /> <br />shall be and the same is hereby amended: <br /> <br /> 1331.08 TAMPERING PROHIBITED. <br /> (a) No person shall, without privilege to do so, knowingly move, deface, damage, <br />destroy or otherwise improperly tamper with a smoke detector or carbon monoxide (CO) <br />cl~ector required to be installed pursuant to the provisions of this chapter so as to destroy <br />or diminish its effectiveness or availability for its intended purpose. <br /> <br /> (b) Any smoke detector or carbon monoxide (CO) detector found to be tampered <br />with shall be replaced with a hard wired device (missing or inoperable batteries shall not <br />constitute tampering). <br /> <br /> (1) Any smoke detector which is missing a battery or has an inoperable <br />replacement battery shall be replaced by the responsible party with a tamper-proof <br />smoke detector with a sealed battery. <br /> <br /> (2) On January I, 2000, all battery powered smoke detectors in the City shall <br />be rarnper-proof smoke detectors with a sealed battery. <br /> <br /> Section 10. That Section 1331.97 of the Building Code of the Codified <br />Ordinances of tho City of Lakewood, now reading as follows: <br /> <br />1331.97 IExlFORC~. <br /> The Building Commissioner and Fire Chief shall have concurrent jurisdiction_to_inspect <br />the installation of any smoke detector required to be installed by this chapter and any <br />violations found to exist shall subject the property owners to the penalties set forth in <br />Section 1331.99. <br /> <br />shall be and the same is hereby amended: <br /> <br /> 1331.97 ENFORCEME1VI". <br /> The Building Commissioner and Fire Chief shall have concurrent jurisdiction_to_inspect <br />the installation ofa~.y smoke detector and/or carbon monoxide (CO) detector required to <br />be installed by this chapter and any violations found to exist shall subject the property <br />owners to the penalties set forth in Section 1331.99. <br /> <br /> Section I I. That Section 1331.99 of the Building Code of the Codified <br />Ordinances of the City of Lakewood, now reading as follows: <br /> <br />1331.99 PENALTY. <br /> Whoever violates any provision of this chapter or falls to comply with any written <br />notice or written order issued hereunder, is guilty ora minor misdemeanor for a first <br />offense and for a second or subsequent offense shall be guilty ora misdemeanor of the <br />fourth degree. Each day's violation shall constitute a separate and distinct offense. <br /> <br />shall be and the same is hereby amended: <br /> <br />1331.99 PENALTY <br /> Whoever violates any provision of this chapter or tails to comply with any written <br />notice or written order issued hereunder, is guilty ora minor misdemeanor for a first <br />offense and for a second or subsequem offense shall be guilty, of a misdemeanor of the <br />fourth degree. Each day's violation shall constitute a separate and distinct offense, All <br />fines imposed as a result ora violation of any provision of this chapter will be deposited <br /> <br /> <br />
