shall be and is hereby amended to read as follows: <br /> <br />902.10 <br /> <br />Wastewater Improvement Fund; Wastewater Collections <br />SysTem Fund; and Wastewater Treatment Fund. <br /> <br />(a) All property taxes designated for wastewater system use and all of <br />the capita charges portion of the variable charges shall be kept and <br />maintained in a separate fund in an account hereby designated the <br />1Nastewater Improvement Fund. The revenues from all bonds and notes <br />issued for the acquisition and installation of such system shall accrue to <br />this account and be used for improvement and extension of the <br />wastewater collections system and the wastewater treatment plant. <br /> <br />Ib) All of the user charges portion of the variable charges relating to <br />the wastewater collections system shall be kept and maintained in a <br />separate fund in an account hereby designated as the Wastewater <br />Collections System Fund. All operating maintenance, repair and <br />replacement costs for the wastewater collections system shall be paid <br />from this Fund. <br /> <br />(c) All of the user charges portion of the variable charges relating to <br />the wastewater treatment plant shall be kept and maintained in a <br />separate fund in an account designated as the Wastewater Treatment <br />Fund. All operating, maintenance, repair and replacement costs for the <br />wastewater treatment plant shall be paid from this Fun d. <br /> <br />Section 2. That the Director of Finance is hereby authorized and directed fo <br />take the necessary steps to establish and rename said accounts to receive <br />revenues and to make expenditures from said accounts for the above <br />described purposes. <br /> <br />Section 3. It is found and determined that all formal actions of this Council <br />concerning and relating to the passage of this ordinance were adopted in an <br />open meeting of this Council, and that all such deliberations of this Council and <br />of any of its committees that resulted in such formal actions were in meetings <br />open to the public in compliance with all legal requirements. <br /> <br />Section 4. That this ordinance is hereby declared to be an emergency <br />measure far the reasons stated in the preamble hereof and provided it receives <br />the affirmative vote of two-thirds of all member elected to Council, it shall take <br />effect and be in force immediately upon its adoption and approval by the <br />Mayor; otherwise, it shall take effect and be in force after the earliest pedod <br />allowed by law. <br /> <br /> President <br /> <br />Clerk <br /> <br />Mayor <br /> <br />Paae 2/2 <br /> <br /> <br />
