or demolition may be recovered by an action at law against the owner, or may, by action of <br />Council by resolution certified to the County Auditor, be added to the tax duplicate as an <br />assessment against the land of the owner upon which the structure stands or die stand and <br />shall become a lien thereof, and shall be collected in the manner provided by law for <br />assessments. <br /> <br />EMERGENCY AUTHORITY <br /> <br /> (n) Imminent Danc~er. If a building or structure creates a substantial dsk to the life or <br />safety of its occupants due tc the imminent or potential failure or collapse of said structure, or if <br />the structure endangers individuals in the proximity of said structure due to toxic or explosive <br />fumes, vapors or gasses, or explosives, or defective or dangerous equ~Dmem, the Building <br />Official is hereby authorized to order the occupants to vacate the premises. The Building <br />Official shall post at each entrance of said structure a notice stating: "WARNING: <br />OCCUPANCY PROHIBITED BY ORDER OF THE DIVISION OF BUILDING, CITY OF <br />LAKEWOOD, OHIO. THIS STRUCTURE IS A HAZARD. tT SHALL BE UNLAWFUL FOR ANY <br />PERSON TO ENTER THE PREMISES WITHOUT THE WRITTEN CONSENT OF THE <br />BUILDING COMMISSIONER." <br /> <br /> (0) Temp0r~ry Safecluards. The Building Official is authorized to order the abatement of <br />an unsafe condition of a building or structure that poses an imminent danger to occupants or <br />others, to include the boarding-up of openings, the cessation of utilities, etc. Such authority is <br />a temporary safeguard until a proper legal procedure or hearing can be held. and any action <br />taken by the Building Official must not exceed the scope of what is deemed necessary to meet <br />an emergency. <br /> <br /> (p) Cos~ of Emerqencv Reoairs. Costs incurred in the performance of emergency work <br />shall be paid from the treasury of the jurisdiction on approval of the Building Official. The <br />Department of Law of the City of Lakewood shall institute appropriate action against the owner <br />of the premises where the unsafe condition is or was located for the recovery of such costs. <br /> <br /> 1306.53 FURNISHING CERTIFICATE TO PURCHASER OF MULTIPLE <br /> DWELLINGS/CERTIFICATE TO PURCHASER OF ONE OR MORE RENTAL <br /> UNITS, <br /> Whoever sells, conveys, leases or otherwise transfers an interest in real property, which <br />has situated thereon a rental dwelling structure, shall secure a Certificate of Occupancy from <br />the Building Commissioner and shall fumish said Certificate to the purchaser, lessee or <br />transferee prior to the execution of the land contract or the delivery of the deed, lease or <br />conveyance. Whoever sells, conVeys, or otherwise transfers an interest in any structure, which <br />has situated thereon any .rental dwelling unit or dwelling unit that has been rented or leased to <br />any person within the 24 months preceding the conveyance or transfer, shall secure a <br />Certificate of Occupancy from the Building Commissioner and shall furnish said Certificate to <br />the purchaser or transferee pdor to the recording of the land contract or the delivery of the deed <br />or conveyance, whichever shall first occur. <br /> <br /> This section shall have no application to lawful one and ~wo family structures or <br />condominium units occupied by the owner as the owner's principal residence at the time of the <br />conveyance or transfer and for the 24 months preceding the conveyance or transfer. <br /> <br /> Whoever fails to comply with the provision of this Section shall be guilty of a misdemeanor <br />of the first degree. <br /> <br /> 1306.54 DUTIES OF ESCROW AGENT. <br /> No person, firm or corporation acting in the capacity of an escrow agent in any real estate <br />transaction involving the sale of any rental dwelling structure or dwellings requiring a housing <br />license pursuant to Section 1306.43 shall transfer title or distribute funds until there has been <br />deposited in escrow an acknowledgment from the buyer of the receipt of a copy of the <br />Certificate of Occupancy required by Section 1306.53, housing license required by Section <br />1306.43, and the provisions of Section 1306.53 have been complied with. Whoever fails to <br />comply with the provisions of this Section shall be deemed guilty of a misdemeanor of the fourth <br />degree. <br /> <br />17 <br /> <br /> <br />
