The code official, officer or employee charged with the enforcement of this code, while <br />acting for the jurisdiction shall not thereby be rendered liable personally, and is hereby relieved <br />from all personal liability for any damage accruing to persons or property as a result of any act <br />required or permitted in the discharge of official duties. Any suit instituted against an officer or <br />employee because of an act performed by that officer or employee in the lawful discharge of <br />duties and under the provisions of this code shall be defended by the legal representative of the <br />jurisdiction until the final termination of the proceedings. The code official or any subordinate <br />shall not be liable for costs in any action, suit or proceeding that is instituted in pursuance of the <br />provisions of this code; and any officer of the department of building inspection, acting in good <br />faith and without malice, shall be free from liability for acts or omission in the performance of <br />official duties in connection therewith. <br /> <br /> 1306.71 DUTIES OFTHE BUILDING OFFICIAL. <br /> The Building Official shall as neec~ed submit recommendations for amendments or <br />deletions to this Code to the Director of Public Safety. <br /> <br /> 1306.99 FOR FAILURE TO COMPLY WITH A NOTICE OR NEGLECT OF <br /> MAINTENANCE. <br /> (a) Whoever refuses, neglects, or fails to comply with an order to stop work issued under <br />the provisions of this Code or other applicable Codes of the City; or refuses, neglects, or fails to <br />comply with a notice to repair, rehabilitate, or demolish a building or other structure declared to <br />be unsafe under the provisions of this Code, or refuses, neglects, or fails to comply with a <br />notice requiring the abatement or removal of a violation or requiring compliance with any <br />provision of this Code or other applicable Codes or any rule or regulation hereunder within the <br />time limit set forth in such notice, or maintains a use or occupancy prohibited by this Code; shall <br />be guilty of a misdemeanor and upon conviction thereof shall be fined not less than twenty-five <br />($25.00) dollars nor more than one-thousand ($1,000.00) dollars for a first offense, and for a <br />second Or subsequent offense shall be, guilty of a misdemeanor of the first degree. Each day <br />such violation occurs or continues shall constitute a separate offense. <br /> <br /> (b) The imposition of any penalty shall not preclude the Director of Law from instituting an <br />appropriate action or proceeding in a court of proper jurisdiction to prevent an unlawful repair or <br />maintenance; or to restrain, correct or abate a violation, or to prevent the occupancy o~ a <br />building, structure or premises, or to require compliance with the provisions of this Code, or <br />other applicable laws, ordinances, rules or regulations, or the orders or determinations of the <br />Building Commissioner, the Mayor, the Board of Zoning Appeals and. Board of Building <br />Standards and Building Appeals. <br /> <br /> Section 4. it is found and determined that all formal actions of this Council concerning and <br />relating to the passage of this ordinance were adopted in an open meeting of this Council, and <br />that all such deliberations of this Council and of any of its committees that resulted in such <br />formal action, were in meetings open to the public in compliance with all legal requirements. <br /> <br /> secti~ 5.
